중형주의적 형벌정책에 관한 비판적 연구

국문 초록

중형주의적 형사정책은 -특히 성범죄를 중심으로- 시민들의 강력한 처벌요구와 함께 강화되어왔다. 성범죄에 대한 보안처분 가운데 전자감시제도, 성충동약물 치료제도가 대표적이다. 형벌은 사회적 합의와 규범의 신뢰를 바탕으로 사회의 문제를 해결해 준다는 믿음으로 관철되어 있다. 형사특별법은 확대되고 형사제재 의 정도 역시 강벌화 되어가고 있다. 이러한 현상이 전통적인 형법이 추구하고 있는 법치주의 형법국가의 기본이념과 헌법이 추구하고 있는 인간존엄의 가치 그 리고 형법이 추구하고 있는 최후수단성인 보충성 원칙에 위배될 여지가 있는지에 관해 점검해 보기로 한다. 먼저 중형위주의 강벌화 정책의 원인과 배경을 밝히고 새롭게 도입된 보안처분들인 전자감시제도와 성충동약물치료제도가 범죄예방에 효과를 거두고 있는지에 관한 문제점을 검토한다. 왜곡된 형태의 여론보도와 형벌강화의 요구에 의한 형사입법의 양산은 합리적 해결방식이 될 수 없을 것이다. 이 문제는 중형 위주의 형사정책이 형사법의 틀 속에서 어떻게 제도가 운용되고 처리되어야 하는지의 문제이기도 하다. 잠재적 범죄자에 대한 위하를 통한 범죄 예방이라는 형벌의 목적은 중벌화의 이데올로기를 정당화시킬 수 없다. 다시 말 해서 더 많은 형벌에 형벌의 자기제한의 목소리를 내고자 한다. 이와 함께 범죄로부터 사회 안전에 대한 기대를 중형주의 정책을 통해서 달성할 수 있는지에 관해 문제를 제기해 보면서 형벌의 진정한 의미에 관해 고민해 보고자 한다.

영문 초록

The tendency of the severe punishment principle in criminal policies is on the rising phase in the face of a series of criminal cases in 2000s. Especially, the increase of atrocious crimes, including cases of sex crimes is referred to as the main cause of this trend. The relevance of the severe punishment in preventing crimes, or the problem regarding the utility of punishment in holding down second conviction is related to the nature of the criminal law and are seated as one of the most controversial issues in criminal policies. Traditionally, punishment has been believed to be a panacea for all problems in the society. This has worked as people reckon that strict punishments on the criminals would prevent their future engagement in another crime. The idea of retributive justice directly follows this line of thought. The role of integrating the traditional criminal law to new social control initiatives is not unavailable, but available only in limited spheres; because, the traditional criminal law merely deals with the reactive actions to the specific rule infringements that have already occurred. As preventive actions are understood to be solely futureoriented, the means of the traditional criminal law cannot capture relatively non-specific risks. Therefore, this paper investigates the meaning and the cause of the rising tendency of the severe punishment principle in criminal policies, and it surveys the concept of the severe punishment principle, its relevance to the sentencing, and the background of the severe punishment principle at the same time. Typical examples of the severe punishment principle include the problem of raising the statutory penalty, excesses of special criminal laws, the strengthening of sentencing guidelines, and the need for a special preventative social care. Among them, the social side effect of sentencing punishments based on the punitivist policy, especially in the cases of sex offenders, is already severe. For this reason, this study concentrates on the criminal sanctions of the electronic supervision system and chemical castration, which are typical preventive measures on sex offenders, in the course of clarifying the basis of punitive criminal policies and reviewing its drawbacks. Finally, this study discusses the effects of the severe punishment principle in criminal policies on crimes and whether a solution exists, accompanying the cause of punishment. The purpose of this paper is to critically study the punitive criminal policy which keeps strengthening the power of punishment.
