더 많은 소수정당이 더 나은 민주주의를 담보하는가?

국문 초록

정당은 한편으론 사회영역에서 자발적으로 조직된 시민들의 사적 결사임과 동시에 다른 한 편, 국가를 조직하고 운영하는데 필수적인 역할을 한다는 점에서 공적 기능을 담당하고 있다. 오늘날 대의제 민주주의에 있어 국민의 의사는 정당을 통해 정치과정으로 전달되므로, 다양한 국민의 의사가 왜곡되거나 배제되지 않기 위하여는 가능한 한 다양한 정당들이 존재하는 것이 바람직하다. 그런 의미에서 현대 민주주의 국가의 헌법과 법률은 정당의 자유와 복수정당제를 민주적 질서의 핵심요소로서 보장하고 있는 것이다. 그러나 한국의 정당관련법제는 다양한 정당의 발생과 활동을 보장하기보다는 기성의 정치적 다수파에 유리하게 제도화되어 있다. 아직 인적·물적 자원이 충분치 않지만 발전가능성이 있는 소규모 군소정당, 기성 정치권에 대하여 비판세력이 될 수 있는 혁신적인 신생정당, 사회의 주류세력은 아니지만 정치적 의사결정과정에의 참여가 절실한 정치적 소수파들이 정당으로 결성되어 정치과정에 진입하는 데에 너무나 많은 제약조건들이 존재하고 있다. 이러한 조건들이 개선되기 위해서는 이미 기성 정치권에 자리잡은, 특히 원내에 진출한 정치적 다수파의 견제를 극복하여야 하는 어려움이 있다. 그러나 민주주의 제도는 어떠한 정치세력도 공동체 내에서 이루어지는 정치적 결정을 독점하도록 허용하지 않는다. 민주주의가 제대로 작동되기 위해서는 정치적 반대세력간의 대립과 비판적 사회세력이 반드시 필요하다. 그러기 위하여는 시민들의 다양한 정치적 의사를 매개할 수 있는, 가능한 한 많은 정당들이 자유롭게 형성되고 활동할 수 있도록 제도적으로 보장되어야 할 것이다. 따라서 다양한 정치적 소수파들도 정당을 결성하고 활동할 자유를 보장할 수 있도록 현행 정당관련법제의 개선이 필요하다. 정당없이 민주주의 없다는 말이 옳다면, 소수정당없이 민주주의는 성공할 수 없다는 말도 옳기 때문이다.

영문 초록

Though Political Parties are private associations which are voluntarily organised in the society, they have a highly public function as a cornerstone for democracy. In the representative democracy people's will go into the political process through the political parties. There should be as many political parties as possible not to distort or abandon the diversity of people's will in modern constitutional democracy which guarantees suffrage and equal chance of political participation. Hence, the constitution and laws guarantees a plural-party system as an indispensible political institution. In democratic system, no political group is permitted to monopolize the power of political decision. In order to secure a proper function of democracy, opposition parties and critical civil society are necessary. But in reality, political party regulation unilaterally m favor of ma]or parties seems to lead to the failure of party democracy. The chances to enter the political process of political minor groups such as (1) small parties, which don't have plenty of members and resources but have a possibility of development; (2) new parties, which are innovative and critical against established parties; (3) political minorities, who need to have a voice in the political process, are not guaranteed properly. There are so many obstacles for various political groups to establish political parties that political party regulations need a complete reform. The reform will be confronted with vetoes from the political majorities, i.e. major parties in parliament. Although it seems difficult for us to reform it, but we are obliged to try it for better democracy. If it is right that there's no democracy without political parties, it is also right that democracy can not succeed without minor political parties.
