국문 초록

과거청산은 과거 국가권력에 의한 반인륜적인 범죄행위와, 그것을 통해 부당하게 획득한 지위와 권력을 밝혀내고 정당한 평가를 받도록 하고, 억울하게 희생되었던 국민들에 대한 보상·배상·명예회복 등을 함으로서 그동안 왜곡되었던 정의를 바로 세우기 위함이다. 과거청산의 과제는 크게 민주적 절차에 따른 평화로운 정권 교체, 해당 정권과 그들의 행위에 대한 진상규명, 청산대상자들에 대한 형사처벌, 피해자들의 명예회복과 손해배상 등으로 구분할 수 있다. 1990년대 이후에 민주적 정당성을 확보한 정권이 들어와서야 과거청산에 대한 논의가 진행될 수 있었다 다음에서는 크게 1) 이승만 시대와 전두환·노태우의 신군부 시대, 2) 박정희 시대로 구분하여 과거청산에 대해 살펴보고자 한다. 전자는 불완전하지만 과거청산이 진행되었으나, 후자는 전혀 과거청산이 이루어지지 않았다. 지금까지 여러 이유로 불완전한 청산이 진행되었기에 피해자 또는 일반 국민들이 공감하기 힘든 방향으로 결론 내려지는 경우가 많았다. 물론 시간이 지나가면 점차 사람들의 기억 속에서 불편한 진실은 잊혀질 수 있다. 그러나 잘못된 과거도 우리 역사의 일부이다. 따라서 우리가 지금 바로 잡지 않는다면 과거의 잘못을 반복할 수 있다. 이는 한 개인의 잘못에 그치는 것이 아니라, 대한민국 또는 국민전체가 불행하게 되는 것이다. 이러한 상황에서 대한민국은 올바른 미래로 나아갈 수 없게 된다. 이번 과거청산에 대한 논의를 통해서 민주주의를 실현하고 사회정의를 재정립하며 사회통합을 이룩할 수 있는 계기가 되기를 기대한다.

영문 초록

Whenever a new era has begun or a new government has taken office, the question of dealing with the past transgressions has always been raised. In particular, since the civilian government took power in the 1990s, the Korean government has been trying to deal with the past by enacting various laws concerning revealing the truth, punishing the persons involved, restoring the honor of the victims, and offering compensation for the May 18 Democratization Movement and the Jeju April 3 Incident, etc. Still, such efforts are lacking in many respects. Only after the democratically legitimate government took office in the 1990s, was it possible to discuss dealing with the past. I will examine dealing with the past by classifying it into two categories: 1. the era of Rhee Syng-man and new military rules by Chun Doo-hwan and Rho Tae-woo, and 2. the era of Park Chung-hee. Dealing with the past for the former era has been undertaken, albeit incompletely. However, such dealing with the past for the latter has never been carried out. So far, dealing with the past has been incomplete for various reasons, sometimes leading to conclusions that victims or the general public find hard to swallow. Of course, as time goes by, such inconvenient truths may be forgotten in the memory of the people. However, the wrong past is part of our history. If we do not correct it now, history may repeat itself. This is more than an individual's wrongdoing. Such a situation will make the Republic of Korea and the entire Korean people unhappy. As it is, the Republic of Korea cannot move forward in the right direction. I hope that this discussion on dealing with the past will serve as a great opportunity to realize democracy, reestablish social justice, and achieve social inclusion.
