인보험개정안에 대한 검토

국문 초록

법무부는 2007년 보험계약법 전면개정안을 제출하였다. 개정안에는 많은 조항의 개정이 제안되었으며 그 중 일부 조항은 공감을 얻었다. 그러나 일부 보험사, 사업자단체, 소비자단체, 학계에서는 개정안이 법 개정의 취지를 살리지 못한다며 반대하였다. 특히 상법 제735조 양로보험, 제727조의2 연금보험과 관련하여 제727조 개정안은 연금보험을 그들의 전업영역으로 삼으려는 생명보험회사와 손해보험회사간에 격렬한 다툼을 불러 왔다. 본고는 상법개정안 가운데 생명보험부분만 검토한 것이다. 필자는 보험금청구권에 대한 제3채권자의 압류를 금지한 신설조항인 제 732조의2, 15세미만자 등의 보험계약금지 등에 관한 제732조 개정안 등에 대한 졸견을 제시하였다.

영문 초록

In 2007, the Ministry of Justice to submit the completely revised bill on insurance contract. A great number of articles were proposed in the revised bill. Some of the proposals won the sympathy of the concerned. But a part of insurance companies, business associations, consumer groups and academic experts are adamantly against the revised bill, calling it not met the goal of the reform. Especially the draft of §727 amendment concerning that §735(Endowment Insurance)and §735-2(Annuity Insurance) set off a furious debate between the life insurance company and non-life insurance company, each hoping to annuity insurance to be their own business. This paper review the limited scope of the personal insurance part of the revised bill. In my humble opinion, new §732-2(Restriction of attachment for the right of fixed amount insured) is unreasonable conclusion because the article infringe the third obligee's right. The writer submit private views on 732(Prohibition of insurance contract for those 15 years of age, etc.) etc.
