이어도의 법적 지위 및 관련 문제에 관한 고찰

국문 초록

이어도는 제주 마라도 서남쪽 149㎞에 위치한 수중암초이다. 우리나라는 2003년 이어도에 해양과학기지를 건설하였다. 중국은 이어도에 대해 문제를 지속적으로 제기하고 있다. 이 수중암초는 우리나라와 중국과의 해양경계획정문제와 밀접한 연관이 있으며, 이어도 문제에 대한 중국의 지속적인 도발은 향후 해양경계획정에서 주도권을 잡으려는 전략으로 볼 수 있다. 이 논문에서는 중국과의 해양경계획정에 이어도가 미치는 영향에 대해 분석하였다. 이러한 분석을 위해 제Ⅱ장에서는 이어도의 국제법적 지위를 먼저 확인해 본다. 유엔해양법협약 제121조는 섬의 요건을 규정하고 있다. 이와 함께 협약 제13조(간출지), 제7조(직선기선) 제4항, 제47조(군도기선) 제4항, 제60조(배타적 경제수역에서의 인공섬, 시설 및 구조물) 등의 조항을 분석하여 이어도의 법적 지위를 확인하였다. 다음으로 제Ⅲ장에서는 이어도와 관련된 문제의 발단과 양상에 대해 알아보고, 중국의 의도에 관해 분석하였다. 제Ⅳ장에서는 이어도와 관련된 문제에 대한 우리나라의 대응방안을 제시하였다. 여기서는 우리나라의 해양경계획정의 원칙, 한중어업협정 문제, 한일해양경계획정 문제 및 한일공동개발구역 문제, 유엔대륙붕한계위원회 및 방공식별구역 문제 등 이어도 및 해양경계획정과 관련된 제반문제들을 검토한 후 각각의 대응방안을 제시하였다. 이어도와 관련된 문제들은 결국 중국과의 해양경계획정 문제로 귀결된다. 향후 주변국과의 해양경계획정에서 이어도를 포함한 여러 가지 변수를 고려한 종합적인 대응방안을 마련하여야 할 것이다.

영문 초록

Ieodo is a submerged rock located 149㎞ southwest of Marado. Ieodo Ocean Research Station was constructed by Korean government in 2003. China claims the Ieodo issues constantly. This submerged rock related to the delimitation of maritime boundaries between Korea and China, so the China's constant provocations for Ieodo are considered as the strategy to get a hegemony in the negotiations on the maritime boundary delimitation. In the paper, the writer analyzes the impact of Ieodo on the maritime boundary delimitation between Korea and China. For the analysis, the writer look at the international legal status of Ieodo. The regime of islands is prescribed by the United Nations Convention on the Law of the Sea(UNCLOS) article 121. Along with this, UNCLOS article 13(Low-tide elevation), article 7(Straight baselines) paragraph 4, article 47(Archipelagic baselines) paragraph 4 and article 60(Artificial islands, installations and structures in the exclusive economic zone) were analyzed for the definition of the legal status of Ieodo in the Chapter Ⅱ. In the Chapter Ⅲ, the origin and phases of Ieodo issues were researched, and the intentions of China were analyzed. The Korea's countermeasures were suggested in the Chapter Ⅳ. The various issues such as the Korea's principle of delimitation of maritime boundaries, the fisheries agreement between Korea and China, the maritime boundary delimitation between Korea and Japan / Joint Development Zone(JDZ), United Nations Commission on the Limits of the Continental Shelf(UNCLCS) and Air Defense Identification Zone(ADIZ) were analyzed and each countermeasure was suggested in the Chapter. The Ieodo issues come down to the delimitation of maritime boundaries between Korea and China. It is necessary to take more comprehensive measures that considering variables including Ieodo to negotiate with neighboring countries for the maritime boundary delimitation.
