국문 초록

오늘날 연안국가를 포함하는 많은 국가들이 해양의 이용을 극대화하고 해양 주권을 수호하기 위해 각별한 관심을 기울이고 있다. 이제는 해양을 국가의 영토 개념으로 접근하는 시대라 할 만하다. 한국도 예외는 아니다. 북에 북한이 있고 한반도가 강대국들의 틈에 놓여 있어 특유의 지리적이면서도 지정학적인 상황에 있는 곳이 한국이다. 우리나라는 해양의 여러 가지 기능에 대한 파악과 그 중요성을 인식해야 한다. 그러한 맥락에서 해양에서의 안보, 주권수호, 및 해상안전을 위해 유효적절한 해양에서의 경찰작용이 있어야 한다. 해양에서의 경찰의 역량을 강화하는 것은 우리나라가 처해 있는 국제정세에 비추어 보아 아무리 강조해도 지나침이 없다. 지난 세월호 사건에서 해양경찰은 초기 구조 등 잘못으로 인해 많은 지탄을 받은 바 있으나, 대외적으로 주변국들의 해양에서의 도발에 엄중히 대처하고 또한 대내적으로는 국민의 생명과 재산의 안전을 지킬 수 있는 해양에서의 경찰로 거듭날 수 있도록 국가적·국민적 편달(鞭撻)과 아울러 다시금 지원이 필요하며 바로 지금이 그러한 때다. 해양은 특유의 공간적인 성질로 말미암아 국제성을 지닐 수밖에 없다. 우리나라의 해양경찰이 명실상부한 해양에서의 법 집행기관으로서의 모범을 보이기 위해서는 국내법에 근거하고 또한 국제법제에 일치되는 경찰작용을 펼쳐 나가야 하겠다. 필자는 해양에서의 경찰력의 강화와 국가 해양력의 증강은 비례한다고 본다. 해군력과 함께 해양에서의 경찰력도 국가 해양력의 크기에 지대한 영향을 미치는 요소라 할 수 있기 때문이다. 강대국이랄 수 있는 중국 및 일본과의 대향국의 관계에 있는 한국은 이 점을 한시라도 잊어서는 안 될 것이다.

영문 초록

Recently, States including coastal States pay enormous attention to the enlargement of marine use and protection of marine sovereignty. Nowadays the seas are considered to be land territories. There is no exception to South Korea. South Korea lies in a very unique geopolitical and geographic situation in that it faces North Korea at its North and is surrounded by some powerful nations such as China and Japan. Thus South Korea needs to recognize the importance of maritime police functions. In this sense there should be maritime police actions which are done effectively in order to protect maritime sovereignty and maritime security. Reinforcement of maritime policing cannot be stressed strongly enough in light of the geopolitical circumstances of South Korea. The Korea Coast Guard has been denounced for its mishandling of rescue operations in the Sewol incident. However, South Korea needs to give rather more assistance and whippings to the KCG in order for it to become a new organization which can powerfully deal with provocation from the neighboring States outwardly and to protect people's lives and property inwardly. The seas are uniquely characterized because of its location. Thus in order for the KCG to show best practices in the maritime field as a law enforcement organization, its function and action must be based both on national laws and on international laws. Finally the author considers that reinforcement of maritime policing leads to the enlargement of the nation's sea power. Maritime police along with the navy is an element for influencing the size of sea power. South Korea which has China and Japan as its neighboring States should not dismiss it even for a moment.
