공화적 공존을 위한 정치개혁의 필요성과 조건 : 정부형태 개헌론을 넘어서

국문 초록

민주화의 분수령이 되었던 1987년 6월항쟁이후 한국 민주주의는 세계의 다른 신생 민주주의국가들과 비교해 매우 성공적인 민주화 전환의 사례로 인식될 만큼 꾸준히 성장하여 입헌민주주의를 안정적으로 구축하였다는 대내외의 평가를 받아 왔으나 이명박 정부시기 정치적ㆍ사회적 반대세력에 대한 노골적 탄압에 이어 박근혜 정부 출범 이후 ‘유신의 회귀’를 우려하는 목소리가 나올 정도로 한국 민주주의에 대한 위기감이 한껏 높아진 상태이다. 본 논문에서는 민주주의 위기를 대통령중심의 정부형태에서 그 원인을 찾고 정부형태를 바꾸는 개헌론을 통해 타개해야 한다는 주장의 허실을 규명하고 ‘공화적 공존형 정치개혁’을 위한 현실적 대안을 제시함으로써 무분별한 정부형태 개헌이 아니라 현행 헌법의 정부형태를 정상화하면서 자유민주주의를 실질적으로 진전시킬 수 있는 정치관계법의 자유화와 민주화를 통해 이러한 위기가 극복될 수 있음을 논증하고 그 제도적 조건을 예시적으로 제시한다. 예시적 정치개혁의 내용으로 본 논문이 제안하는 것을 다음과 같이 요약될 수 있다. 자유민주적 기본질서를 전제로 대의민주적 의회정치에서 실질적 국민주권이라는 민주적 정당성이 회복될 수 있도록 국민의 참정권을 확대하는 한편 정치적 표현의 자유를 강하게 보장하는 방향으로 공직 선거법과 정당법, 정치자금법 등 관련 법률의 획기적 개선을 통한 정치개혁 달성이 요청된다. 또한 국회의원 정수를 획기적으로 개선하여 국정통제를 강화하고 민주적 공론화과정을 확보하는 한편 비례대표제적 선거개혁을 가능하게 해야 한다. 의정과정에서도 소수파를 활성화시키기 위한 교섭단체제도 등을 개혁할 필요가 있다. 이와 함께 시민의 목소리가 의회에 반영될 수 있는 장치를 제도화하고 정치엘리트와 시민 간의 괴리를 극복함으로써 국민주권의 실질화에 보다 기여할 수 있어야 할 것이다. 이러한 다원적 민주주의의 토대위에서 현행 헌법의 혼합제 정부형태의 장점을 살려 연정이 일상화되는 합의제 민주주의로의 전환을 추구하는 것이 민주주의의 위기를 정면으로 돌파하는 현시대적 과제이다. 이와 함께 대립과 갈등의 정치문화는 그 자체가 원인이라기보다는 정치독과점구조와 국민주권의 박탈을 정당화하는 정치제도와 사회문화의 결과이므로 대화와 타협의 정치제도와 문화로 바꾸는 ‘공화적 공존’을 위한 정치개혁과 의식개혁이 필요하다.

영문 초록

Since the Peoples' Uprising in 1987 resulted in the establishment of the so-called “1987 Constitutional System”, most Koreans have been proud of their achievement in democratization. However, the Korean democracy under the reign of the two consecutive conservative presidency since 2007 has been seriously deteriorated to the level of the authoritarian Yusin period. A number of politicians and political commentators tend to ascribe the crisis of Korean democracy or high political inefficiency to the imperial presidency embedded in the current constitutional arrangement. A natural consequence of this argument is the constitutional revision movement for the semi-presidential system or cabinet system. This article aims to examine a couple of rationales of this movement from a critical perspective and to provide desirable alternatives to them in terms of how to realize a republican co-prosperity pertaining to the democratic republic. The authors' main argument challenging the constitutional revisionists is that the current form of government is already a semi-presidential system which allows a wide parliamentary checks and balances vis-a-vis the presidency. They point out that the reality of imperial presidency reinforced in the Park Geun Hye Government is not caused by the constitutional powers of the President but by the misuse or abuse of law enforcement powers. Given that, it is argued that the desirable political reform must focus on the liberalization of the political process and the empowerment of the citizens in politics. The necessary reform proposals must include the introduction of proportional election system, the repeal of a number of political regulations articulated in the Public Officials Elections Act, the Political Parties Act and other political regulation laws, and parliamentary reforms such as the increasement of the number of the National Assemblymen, the rationalization of negotiation group system, the introduction of intensified quorum in the selection of independent public officials like the Constitutional Justices and the Supreme Court Justices.
