통일 후의 의회형태로서 양원제

국문 초록

양원제는 의회를 두 개의 원(chamber)으로 구성하는 제도를 말한다. 의회가 두 개의 원으로 구성되면 의회는 상이한 집단에 속하는 국민을 대표할 수 있다. 이처럼 두 개의 원으로 구성된 의회는 다양한 집단의 의사와 이익을 반영하여 더 많은 국민들이 동의할 수 있는 결정을 신중하게 내릴 수 있다. 또한 의회 안의 권력분점을 통해 입법기관 내부의 견제와 균형을 통한 권력의 통제가 가능해진다. 하지만 다양한 집단의 의사와 이익을 반영하게 되면 합의의 도출이 쉽지 않고, 그만큼 중요한 국가의사결정이 지연될 수밖에 없다. 그리고 동일한 정당이 두 개의 원에서 모두 다수당이 되면 사실상 입법기관 내부의 견제와 균형도 유명무실해질 수 있다. 미국이나 독일과 같은 연방국가에서 상원은 지역대표성을 갖는다. 반면에 영국의 상원은 귀족대표의 전통을 가지고 있고, 아일랜드의 상원처럼 직능대표의 특성을 가지는 경우도 있다. 상원과 하원의 관계에 대해서는 상원과 하원의 의견이 불일치할 때 하원의 결정이 상원의 결정보다 우월한 영국식과 일본식이 있는 반면에 상원과 하원이 대등한 지위를 갖는 미국식과 독일식도 있다. 양원제는 헌법원리에 비추어 볼 때 민주주의의 관점에서 소수의 의사가 대표될 수 있도록 하고, 권력분립의 관점에서 새로운 형태의 권력분립을 가능하게 하며, 지방차치의 관점에서 지방주민의 의사와 이익이 대표되도록 할 뿐만 아니라 평화통일의 관점에서 통일 후 북한주민의 의사와 이익이 적절하게 대표되도록 할 수 있다. 한국에 양원제가 도입되는 경우에는 상원의 구성방식, 정부형태와의 관계, 연방제 도입 여부, 선거제도의 유형 등에 대해서 구체적으로 어떻게 결정할 것인지가 중요한 쟁점이 된다.

영문 초록

Bicameralism is a system in which the legislature is comprised of two houses. As the legislature has two houses, it can represent citizens from different groups. As such, a legislature with two houses is capable of reflecting the will and interests of diverse groups, and thus can make decisions that more citizens would consent to. Furthermore, separation of power within the legislature would enable control of power through checks and balances within the legislature itself. However, reflecting the will and interests of different groups of people would make reaching an agreement difficult and consequently, would delay important state-level decisions. Moreover, in case when one political party takes majority in both houses, the system of checks and balances within the legislature may become futile. In federal states such as the United States of America and Germany, the upper house has regional representativeness. On the other hand, the upper house of the United Kingdom has traditionally represented aristocratic system, while that of Ireland is known to represent vocational groups. Considering the relationship between the upper house and the lower house at times when the two disagree, the decisions of the lower house is superior to that of the upper house in the United Kingdom and Japan; in the United States of America and Germany, however, the decisions of two houses are on equal footing. In light of constitutional principles, bicameralism empowers the minority to be represented in terms of democracy, makes separation of power possible in an innovative way in terms of separation of power, represents the will and interest of local citizens in terms of local self-government, and helps appropriate representation of the will and interest of the citizens from North Korea after reunification in terms of peaceful reunification. If the Republic of Korea were to adopt bicameralism, debates on how to specifically decide on the organization of the upper house, the relationship between the legislature and the government, adoption of federal system, and the type of electoral system would rise as critical issues.
