국문 초록

청소년 매매춘에 대한 규제는 법적 규제, 단속적 규제, 유인방안 및 자율규제로 나눌 수 있다. 먼저 매매춘 청소년에 대한 법적 규제는 19세를 기준으로 그 이상인 경우에는 윤락행위방지법의 적용을 받아 형사처벌과 선도보호위탁처분을 받고 그 이하의 경우에는 청소년성보호법의 적용을 받아 소년법상의 소년보호처분을 받게 받게 되는 반면에 성인복지범은 형사처벌과 신상공개, 보안처분을 받을 수 있을 것이다. 청소년 매매춘은 이를 연결하고 매개하는 수단을 규제하는 것이 효과적이라고 판단되므로 중간매개집단과 정보통신매체의 단속을 강화해야할 것이다. 마지막으로 유인방안 및 자율규제는 매매춘 청소년과 성인상대방의 신고유인, 풍속영업자에 대한 신고유인, 지방자치단체의 청소년보호에 관한 조례제정 등을 통하여 규제할 수 있을 것이다.

영문 초록

Juvenile prostitution is divided control schemes into legal regulation, control through enforcement, inducements and voluntary regulation. First of all, legal regulation set on the basis of 19 years old. That is to say, prostitutional juveniles is imposed criminal punishment and guidance protection disposition applicable to Act of Prostitution Prevention in case of 19 years old or more; on the other hand, prostitutional juveniles is imposed juvenile protection disposition applicable to Act of Juvenile Sex Protection in case of 19 years old or less. It is desirable that adult offender is imposed criminal punishment, individual information notification, public safety disposition. It is efficient that regulate instrument intermediating juvenile prostitution. therefore we must reinforce enforcement of mediation group and telecommunication media. Lastly, it will regulate by inducement that report prostitutional juveniles and it's adult partner to police, report amusement and entertainment business proprietor to police. In addition to this, local self-governing body should control through enactment of ordinance on juvenile protection.
