제19대 국회의장 직속 헌법개정자문위원회의 헌법전문과 총강부문 개정안에 대한 비교헌법학적 연구

국문 초록

현행헌법 시행 27년을 지내면서 특히 2000년대 이후 개헌논의는 우리 사회의 끊이지 않는 화두였다. 헌법규범과 헌법현실의 괴리가 나타나고, 빠르게 진행되는 국제화에 부응하지 못 하며, 통일을 대비하기에도 부족하다는 규범자체의 흠결은 물론 운용상의 문제까지 지적되면서 개헌의 필요성이 끊임없이 대두해 온 것이다. 특히 현행헌법은 최초의 여야합의에 의해 이루어졌다는 점은 인정하지만, 제정과정에서 충분한 국민적 논의를 거치지 못 하고 짧은 시간 안에 정치권 안에서만 근시안적인 이해관계의 절충을 시도했음을 부인하기 어렵다. 이같은 현행 헌법에 대한 문제의식과 그로부터 발생하는 개헌의 필요성과 당위성에 관한 국민적 공감대가 15년 이상 꾸준히 형성되어 온 것이다. 이러한 일련의 연속적인 개헌논의 가운데 제19대 국회의장 직속 헌법개정자문위원회가 2014. 5. 23. 발표한 개헌안은 헌법전문과 총강부분부터 기본권부분과 통치구조까지 획기적인 변화를 예고하고 있다. 특히 9번의 개헌과정에서 거의 변화가 없었던 헌법전문과 총강부분이 상당히 바뀌었다. 헌법전문의 경우 제헌헌법의 전문을 그대로 살리고 제10차 개헌전문을 별도로 둠으로써 二元化하였다. 현행헌법에서 백지위임 되어 있는 국민의 요건도 始原性의 근거를 명문화했고, 국가상징을 도입함으로써 국민통합의 계기를 만들었다. 또 `모든 권력은 국민을 위하여 행사된다`는 규정을 명문화함으로써 대한민국의 정체성을 보다 확고히 하고, 권력에 대한 불신을 해소하며, 국제화시대에 부응하면서, 동시에 국민통합을 통해 한반도 통일에 대비할 수 있는 디딤돌을 마련했다고 평가할 수 있다. 본 논문에서는 이상과 같은 개헌자문위의 개헌시안 가운데 헌법전문과 총강을 비교헌법적으로 고찰하면서 그 의의와 문제점을 살펴보았다.

영문 초록

It has been more than 20 years since enforcement of the current constitution which was reformed by the first agreement between the ruling and opposition party. Nowadays the constitutional reform has become a type of topics to discuss. Needs for constitutional reform has been controversial among our society such as politicians, scholars, and media. For instance, members of National Assembly established Constitutional Reform Research Group Association and `Constitutional Reform Advice Committee` was formed by the Speaker of National Assembly in internal National Assembly. Also opinion poll for necessity of constitutional reform is continued in our society broadly. Such high interest and motivation led wide range of work through our society such as gathering various opinions and making public opinions. Finally provisons of constitutional reform was published as a form of proposal for constitutional reform by Constitutional Reform Advice Committee on 23th of May 2014 in National Assembly. The latest reform proposal is notable compare to previous constitution. The previous constitution contained 10 chapters and 130 clauses, but this proposal has 11 chapters and 161 clauses. The preamble which had never been changed on a large scale after the established constitution of Korea(1948) is also reformed in a large way as a dualised form in this revised bill. The codification of Constitutional Basic Rights is externally similar to European Union Human Right Charter. The governance structure shows significant changes that the power of president is limited to Foreign Affairs, National Security and the Unification, that means Dual Executive system is introduced. The level of this reform bill is highly broad in the sense that the national assembly could be bicameral system and the Board of Audit and Inspection is divided into two: Government Accountability Office and Institution for Inspection. Human Resource Recommendation Committee is now established to prevent biased decision makings on appointment of governmental people. But this dissertation will only concern about the Preamble and the general provision, and rests such as Human Rights and Governance Structure will be mentioned in next assignment a cause of the quantity limit.
