국문 초록

한국의 국력신장과 개방화 추세로 외국인의 입출국 사례가 급증하고 있다. 또한 보다 나은 경제적 여건을 추구하면서, 국내에 체류하거나 이주하는 외국인도 증가하고 있다. 국내 노동력 부족 현상을 해소하기 위한 도입된 고용정책의 일환으로 출발했던 외국인 정책이 이제는 '다문화사회'를 촉진하고 있는 상황이다. 외국인의 비율이 2.34%에 달하고 있다. 다양한 국적의 체류 외국인들이 증가함으로써 예기치 못한 문제들이 수반되고 있다. 특히 살인 등 강력범죄 및 조직범죄화 경향은 체류외국인 규모와 비교할 때, 간과할 수 없을 정도의 질적 심각성을 내포하고 있다. 체류 외국인의 비율이 5% 이상되는 선진 각국에서는 외국인 범죄문제를 범정부적으로 대처하고 있다. 최근 한국 정부가 표방한 '통합과 인권'이라는 외국인 정책의 큰 틀 안에서, 경찰 등 형사사법당국을 중심으로 외국인 범죄를 해결해야할 시점에 와 있다. 외국인 범죄는 내국인 범죄와는 특이한 배경과 양상을 띠고 있는바, 입국심사단계, 신상자료의 확보, 지역사회내 통합단계에서의 경찰활동, 수사과정에서의 인권침해 가능성 최소화, 효율적 수사활동, 재판 및 형사소송절차에서 특별한 취급, 교정단계에서 맞춤식 처우가 긴요시되고 있다. 외국인 범죄문제에 1차적으로 대처하는 경찰의 역할을 중심으로 지역사회내 통합촉진 및 인권침해 가능성을 줄이는 방안을 제시하였다. 본 연구는 외국인 범죄의 특성을 분석하여 차별화된 전략을 모색하고 있다.

영문 초록

As the result of the expanded national power and the positive effect of liberalization, and with the better economic conditions, the number of immigrants in Korea or the visits from overseas has sharply increasing. The policies for foreigners, which aimed to solve the labor force shortage issue, are now promoting the multi-cultural society in the Korean peninsula. The proportion of the foreigners populated in Korea has reached 2.34% out of the total national population. This dramatic change, however, also has brought some unexpected issues that need to be concerned. As a matter of fact, it's been said that keeping the public peaceful concerning the criminal behaviors committed by foreigners has not caused any further trouble, but in comparison with the foreigner population in Korea, the increasing number of violent acts, such as murder, or organized crimes committed by the foreigners requires a great deal of concern. In developed nations, the foreign polices of crime are taken by the involvements of various organizations including the government. Now it is the time for the Korean government and the criminal justice system to resolve the issue and support the police of 'integration and human rights.' Due to the fact that the aspects of the crimes committed by foreigners differ from the ones by the locals, it requires strict police actions in entry screening, individual crime record selection process, community involvement, and proper procedures in minimizing the violation of human rights, investigating efficiently, dealing with specific regulations in trials and criminal justice procedure and corrections. Recently, the studies on these issues have been suggested and discussed vigorously. This research aims to analyze the characteristics of the crimes committed by foreigners and to suggest sufficient strategies for different types of crime. In addition, it further focuses on the roles of police in promoting community integration and reducing infringement of human rights.
