경찰수사에 관한 언론의 보도관행 연구

국문 초록

이 논문은 언론보도에 나타나는 경찰수사행태의 문제점을 개관하면서 보도관행을 추론하고 보도에 나타나고 있는 문제점을 고찰하는데 목적을 두었다. 2004년부터 2008년에 발생한 사건별 비난기사 내용(총 114건)을 크게 3가지 프레임으로 분류하였다. 즉 수사활동 86건(피의자 인권침해 포함), 피해자보호미흡 16건, 수사관 비행 12건으로 분석하였다. 언론기사보도에서 보이는 수사비난 상용구들은 '뒷북수사', '반쪽수사', '부실수사', '편파수사', '늑장수사', '함정수사', '졸속수사', '허술한 수사', '무리한 수사', '허점투성이', '실적 중심수사', '봐주기 수사', '마구잡이 수사'로 나타나고 있다. 특히 강력범죄사건에 대한 경찰의 초기대응이나 검거방식이 미흡한 경우가 비일비재하다는 점은 반론의 여지가 없다. 그러나 경찰의 사건수사 관련기사보도는 보다 신중하고 중립적이며 표현의 정제가 필요하다. 첫째, 범죄피해에 대한 두려움 조성이다. 극적인 범죄의 발생과 무능한 경찰의 이미지를 결합시키는 보도를 통해 특히 어린이 유괴사건이나 성범죄에서 두려움은 배가될 수밖에 없다. 둘째, 수법의 모방이다. 범죄보도는 범죄의 자세한 수법을 소개하여 잠재적 범죄자들이 수법도 배우고 수사를 피해가는 방법도 배울 수 있다. 셋째 언론의 공정성측면이다. 관행처럼 검찰취재를 그대로 여과없이 보도하고 법원에서 수사의 문제점이 드러난 경우 공소제기 및 유지를 담당한 검찰보다는 경찰에게 수사책임을 지우면서 '나쁜 경찰', '경찰얼차려', '막가는 경찰'을 강조하고 결국 불신을 키우게 된다. 언론이 갖는 비판과 감시기능은 경찰의 수사행태에 대해서는 거의 부정 일변도의 보도가 특성이다. 언론윤리적 측면에서 공정성은 보도에 균형감각을 유지하는 형평성을 의미하는데 무엇보다도 언론인은 사건의 관찰자이어야 하며 참여자가 되어서는 안된다. 언론과 경찰간에는 보다 깊은 이해와 보다 많은 소통이 필요하다.

영문 초록

The purpose of this study is to find a current reporting style and any reasons for media to be very critical against police investigations by means of sifting through unfavorable reports. A total of 114 items analysed among investigation-related cases from 2004 to 2008 includes 86 investigative practices and 16 handling criminal victims and 12 personnel wrongdoings. Significant numbers of newspaper stories have criticized the police in terms of violation of due process of law, failures to arrest, insufficient awareness of human rights, lack of investigation in conjunction with other agencies, performance-based investigation, a shoddy and faulty working as well as initiations not speedy enough. The governmental watchdog role of media is almost always oriented towards negative sides all along as far as police investigation is concerned, which holds criticism without showing any alternatives, reporting in favor of one party and printing private thing which has nothing to do with criminal events. There is a difference between the derogatory expressions of behaviors and those of police investigator, which the latter shows more severe forms to the extend that public recipients may feel so repugnant about the police investigation while the police perceive themselves held by the unfair media. Journal fairness means, from an ethical point of view, that journalist should not be a participant but an observer to event. A need to much refined expressions concerning police investigation has its grounds. Expressions not purified may lead to fixed negative images on police, public security officer. They can, and most times do, generate enormous fear of crime, especially when they combine the dramatic events and the image of incapable police mainly because of media's characteristics of infotainment.
