경찰 반부패전략으로서의 감찰시스템 개선 모형에 관한 연구

국문 초록

이 논문은 궁극적으로 현행 경찰의 감찰시스템 개선 방향을 보다 본질적이고 전략적인 접근방법으로 제시해 보고자 하는 것이다. 경찰의 부패를 척결하기 위한 노력으로는 경찰 감찰제도 이외에도 많은 방법이 있을 수 있겠으나 여기에서는 감찰제도의 목적을 경찰 부패 척결을 통한 청렴도 향상의 가장 근본적인 전략적 접근으로 이해하여 논리구조화하고, 제도비교적인 시각으로 병행 전개하였다. 우선 경찰 부패 발생의 특징으로 작용하는 대민중심의 업무진행, 규제적 성격의 업무, 불규칙한 상황 발생과 재량권의 남용 가능성, 계급조직과 경찰문화, 범죄자 대상 업무 등을 중심으로 경찰 부패 이론과 유형을 검토하였으며, 이에 효과적으로 대응하는 감찰제도가 되기 위한 보완점을 모색하였다. 외국 경찰의 반부패 노력과 각종 대응사례를 검토한 후 크게 네 가지 차원의 제도적 보완점, 즉 시민참여를 통한 부정부패 통제 강화, 불합리한 제도 및 환경 개선, 조직 내부 청렴의식 고취, 홍보 및 통제 강화 방안으로 범주화하여 구체적인 사례와 시사점을 분석ㆍ발췌하였다. 마지막으로 향후 경찰 부패의 차단을 더욱 가속화하고, 기존 감찰시스템의 역기능을 순기능으로 전환할 수 있는 전향적이고도 전략적인 개선 모형을 제도 개선과 운용과정 개선이라는 두 개의 축으로 나누어 제시하였다. 특히 후자의 개선 모형에서는 경찰 감찰 시스템의 과정 평가와 영향 평가를 상시화하고, 모듈화하기 위한 응용이론으로 SARA모델을 채택하여 문제의 탐색, 분석, 대응, 평가라는 단계적 절차에 따라 각 단계별로 구체적인 점검사항과 도구를 제시하였다. 이와 같은 제도적인 보완과 감찰활동 과정의 체계화는 경찰의 부패를 줄이는데 크게 기여할 수 있을 것이다. 이 연구에서는 가급적 추상적ㆍ이론적 수준의 논의보다는 구체적이고 현실적인 대안을 마련하여 현장에서 도입 가능한 방안을 제시하고자 노력하였다. 향후 이 분야에서의 가치지향적이고 실효성있는 후속연구와 활발한 논의를 기대한다.

영문 초록

This study is conducted for proposing the optimal principles of better police internal affairs(inspection) system's direction. There are many ways such as internal affairs system to eradicate corruption of police, but in here, it could be possible to understand internal affairs system's purpose as a fundamental strategic approach to integrity improvement through police anti-corruption program and develop theoretical background and system comparison. Theories and patterns about police corruption focused on a project for a people, a regulated work, affairs occurred irregularly, possibility of discretion abuse, organization in classes and police culture, and criminal directed duties will be examined, and complements for effective internal affairs system will also be groped. After inquiring into other foreign country's tries for anti-corruption program and various confrontation examples, four dimensional systemic complements - control strengthening through citizen participation, improvement irrational system and environmental, inspiration integrity in organization, publicity and tightening the control - could be analyzed with concrete cases. Lastly, strategic improved model is divided into system betterment and operation process improvement that can change existing police internal affairs system's function to better one. Especially, in the latter case, SARA model is selected for police internal affairs system's evaluation, and definite plans will be presented for scan, analysis, response, and assessment in each level. Therefore, through concrete and realistic alternative proposals, systemic complement and internal affairs system's organization are possible to be brought in actual sites.
