국문 초록

우리나라의 교통안전 수준은 경제협력개발기구 가입 국가 중 최하위이다. 교통안전 수준이 낮은 이유는 여러 요인이 있을 수 있으나 기본적으로 교통에 참여하는 사람들이 질서를 지키지 않기 때문이다. 따라서 본 연구는 도로교통에 있어서 교통안전증진을 위한 교통질서 확립방안을 고찰하였다. 제1장에서는 교통의 폐해를 교통안전의 국제적 수준을 비교하여 연구의 필요성을 제기하고 연구의 범위와 방법을 논하였다. 제2장에서는 교통질서의 의의와 교통질서 위반에 관련된 이론을 고찰하였다. 제3장에서는 첫째, 한국의 교통질서 위반 실태는 교통사고 건수, 교통법규위반 건수, 교통문화지수, 교통안전에 관한 의식조사 등의 통계를 통하여 고찰하였으며, 둘째로 교통질서위반 요인은 여러 연구 결과를 중심으로 고찰하였다. 제4장에서는 범죄예방이론에 의한 교통질서확립방안과 합리적 처벌을 통한 교통질서확립방안을 제시하였다. 범죄예방이론에 의한 교통질서확립방안은 ①억제이론 ②치료 및 갱생이론 ③상황이론에 의한 예방방안을 제시하였다. 합리적 처벌을 통한 교통질서확립방안은 ①교통규제의 강화: 합리적 조정, ②인명이나 재산에 중대한 손해를 끼치는 교통범죄에 대하여 형벌을 강화해야하며, ③사회봉사 및 수강명령제도를 활성화하고, ④사면 제한을 제시하였다. 본 논문은 도로교통에 있어서 안전을 증진하기 위한 교통질서 확립방안을 지금까지 시도하지 않았던 범죄예방이론을 통하여 시도하였다는데 의의를 둘 수 있다. 다만 범죄예방이론의 적용에 있어서 이론의 근본 개념을 넘어선 해석이나 방안을 제시한 점도 있을 것이다. 이것이 이 논문의 제약점으로서 앞으로 범죄예방이론을 통한 교통범죄예방에 대한 많은 연구와 검증이 있어야 할 것으로 생각한다.

영문 초록

The traffic safety of Korea ranks the bottom among the OECD(Organization for Economic Cooperation & Development) countries. Though there may be various reasons for that, the basic reason is that people do not observe the traffic rules and orders very well. Therefore, this study considered the measure to establish the traffic order in an attempt to enhance the road traffic safety. In chapter 1, the traffic damage was compared with the international traffic safety standard to put forth the necessity of the study, and discussed the scope and method of this study. In chapter 2, the meaning of traffic order and the theory to prevent the traffic order violation were considered. In chapter 3, first, the current violation of traffic order in Korea was considered, using the statistical analysis on the number of traffic accident, number of traffic regulation violation, traffic culture index, survey on the traffic safety awareness, etc, and second, factors leading to the violation of traffic order were looked into by considering the findings from various studies. In chapter 4, measure to establish the traffic order on the basis of crime prevention theory and reasonable penalty was proposed. The measure to establish the traffic order on the basis of 'crime prevention theory' included ① theory of restraint, ② therapy and rehabilitation theory, ③ preventive measure based on the situation theory. The measure to establish the traffic order based on the 'reasonable penalty' included ① reinforced traffic regulation(reasonable adjustment), ② intensified penalty against the traffic crime that inflicts serious damage to life or property, ③ promotion of community service and class attendance order system, ④ restriction on the pardon. This dissertation is meaningful in that it tried to come up with a measure to establish the traffic order on the basis of the crime prevention theory to enhance the road traffic safety, which has not been attempted until now. However, this dissertation presented the interpretation or measure beyond the fundamental concept of the theory in applying the crime prevention theory. This is the limit of this dissertation, and many studies, as well as their validations, should be conducted in the future on the prevention of traffic crimes on the basis of crime prevention theory.
