경찰의 조직폭력 단속활동에 대한 평가

국문 초록

일반적으로 조직폭력이란 조직범죄 중에서 폭력을 주된 수단으로 하는 형태를 의미하며, 경찰 실무적으로 조직범죄라고 하면 주로 조직폭력과 관련되어 사용되고 있다. 이러한 조직폭력의 경우 경찰과 검찰에서 지속적으로 단속해 오고 있으나 근절되지 않고 있는 고질적인 폭력으로 그 활동범위가 국경을 초월하는 추세를 보이고 있으며, 시민들의 일상생활에 심각한 위협을 초래하고 있다. 이에 이 연구에서는 조직폭력의 개념을 이론적으로 규명한 후 최근 10년간 경찰청에서 발간하는 「경찰백서」의 조직폭력자료, 경찰관과 검사 및 관련전문가와의 심층면접자료를 토대로 경찰의 조직폭력 단속현황을 분석하고 다음과 같은 정책적 제언을 하였다. 첫째, 경찰에서는 2000년을 '정직한 경찰통계 원년'으로 선언하였을 정도로 경찰통계의 정확성을 널리 홍보하고 있으나 여전히 「경찰백서」의 통계는 부정확한 경우가 있으며, 관련 연구자에게 연구에 필요한 자료의 협조요청에도 여전히 비협조적이었다. 따라서 경찰에서 조직폭력에 효율적으로 대응하기 위해서는 공식통계 자료의 정확성을 기하고 관련 전문가에 대한 경찰의 협조적인 태도가 필요하다. 둘째, 「경찰백서」에 집계된 통계에 대한 분석도 전년도의 내용을 그대로 답습하여 자구 하나 둘 정도만 바꾼 데 불과하여 조직폭력의 실태를 정확하게 파악하는 데도 한계가 있었다. 따라서 조직폭력에 효율적으로 대응하기 위해서는 전문적인 식견을 갖춘 경찰관에 의한 경찰통계의 작성과 이에 대한 분석이 필요하다. 셋째, 경찰에서는 매년 조직폭력배의 척결을 '민생치안의 역점과제', '민생치안 확립의 최우선 과제'로 선정하여 '관리대상 조직폭력배를 선정ㆍ전산화'하여 관리하고, 경찰서별로 '폭력범죄 관리구역' 또는 '폭력범죄 특별관리구역'을 설정하여 집중단속활동을 펴고 있으며, 1-3개월의 기간을 정하여 '조직폭력배 검거강화계획', '조직폭력배 집중소탕기간', '조직폭력배소탕 100일 작전', '서민ㆍ소외계층 상대 갈취폭력배 집중단속'과 같은 집중단속활동이 매년 명칭만 바뀐 채 전개되고 있으나 이에 대한 평가가 제대로 이루어지지 않고 있었다. 따라서 경찰에서 조직폭력에 효율적으로 대응하기 위해서는 조직폭력의 단속활동에 대한 평가와 환류가 필요하다. 아울러 특진이라는 '당근'을 제시하고 시행하는 조직폭력배 특별단속계획과 같은 구태의연한 특별작전도 이제는 자제해야 한다. 왜냐하면 조직폭력은 일과성 또는 일회성 정책이나 단속으로 근절될 수 있는 것이 아니고 상시 관심을 기울여야 하는 것이기 때문이다. 넷째, 조직폭력에 대한 정확한 개념의 정립과 조직폭력의 활동과 범행수법의 변천내용에 대한 명확한 파악이 필요하다.

영문 초록

Organized violent crime is a part of the organized crime which is mainly committed with violent methods. Police practically use the term 'organized crime' to deal with organized violent crime because most organized crimes are related to the violence. Even though the police and prosecutors are continuously keeping control over the organized violent crime, they fail in rooting out this type of crime from the society. Now the organized violent crime is happening beyond the boundary of a country and also intimidating the citizen's peace life. This study defines the concept of the organized violent crime theoretically. Then, the author gathered the data about the organized violent crime from the 'Police Crime Report' for last 10 years. Also, the in-depth interview data which was gathered by the police, prosecutors, and other experts was included in this study. Based on theses data, the author analyzes the current state of enforcement against the organized violent crime and the policy for this problem. From this analysis, the author proposes the following policy recommendation. First, the police need to improve the crime statistics. Even though the police declared 'the year of correct police statistics' in 2000, the 'Police Crime Report' is still incorrect in many aspects. Furthermore, the police authorities have shown uncooperative attitudes toward researchers who are asking research materials. Therefore, to respond efficiently against the organized violent crime, the police need to improve the correctness of the police crime statistics and build cooperative attitudes toward researchers and experts. Second, the police need to improve statistical analysis about the 'Police Crime Report' by the expert statistician. The analysis of the 'Police Crime Report' did not improve from the previous years. Therefore, it is difficult to understand the correct situation of the organized violent crime from this analysis. Third, the police set the 'crackdown of violent gangs' as the important police goal for the safety of citizens every year. Each police station develops the computer database for the violent gangs for the enforcement purpose. Also, each police station designates a certain geographic area as the 'special control area' and enforces the organized violent crime intensively in that area. There are also so called 'Intensive enforcement plan against violent gangs,' 'Intensive enforcement period against violent gangs,' '100 days tactic for the crackdown of violent gangs,' and 'Intensive enforcement against violent gangs who are targeting underprivileged citizens.' Even though the police implement these programs every year, there was no evaluation about these. Therefore, to efficiently respond against organized violent crime, the police need to evaluate those programs and give feedback information toward those programs. Furthermore, the so-called 'special tactic' or 'special enforcement' against violent gangs with the carrot of special promotion should be refrained. These one-time oriented policy could not solve the problems of the organized violent crime at all. The organized violent crime should be controlled with continuous and consistent strategy. Fourth, it is necessary to define the concept of the organized violent crime correctly. Also, the activities and crime methods of the organized violent crime should be correctly analyzed.
