조직범죄에 대한 시각변화와 그 정책적 함의

국문 초록

약탈자나 기생자 단계의 조직범죄들은 '모든 악의 근원'으로 인식되어 척결 내지 통제의 대상이 된다. 그러나 최근에는 다수의 조직범죄들이 불법적인 시장개입에서 벗어나 합법적인 사업 활동을 영위하는 쪽으로 변화하면서 지역사회와 공생하는 단계로 발전하게 되었다. 마피아나 신디케이트 같은 세계적인 조직들이 조직범죄의 주류를 이루자 이에 대한 시각도 크게 변화하고 있다. 조직범죄를 하나의 출세수단으로 인식하기도 하고, 후원자나 보호자로 보기도 하며, 고급사교클럽 혹은 다국적 기업으로도 여기게 되었다. 이런 시각변화가 조직범죄를 설명하는 이론들에도 반영되어 신분상승수단이론, 인종승계이론 및 기업이론과 같은 이론들이 대두하게 되었다. 더 나아가 조직범죄가 지역사회에 완전히 정착하였다는 점에 착안하여 조직범죄를 하나의 사회제도로 보는 소위 '지역사회제도론'이 등장하게 되었다. 이 이론은 지역사회가 본질적으로 갖고 있거나 조직범죄가 의도적으로 만든 시장공백을 조직범죄에 의한 재화 및 불법서비스가 메운다는 것이다. 따라서 조직범죄는 지역사회의 하나의 제도가 되어 합법사업이나 합작투자를 통하여 다수의 고용기회를 창출하기 때문에 지역사회가 조직범죄를 수용하게 된다는 것이다. 위와 같은 시각변화와 지역사회제도론의 등장은 조직범죄에 대한 강력한 처벌위주의 정책을 펼쳐온 우리사회의 기본입장과 대비하여 많은 시사점과 토론의 필요성을 제기하고 있다. 조직범죄가 하나의 지역사회제도로 기능함에 따라 선진각국의 조직범죄에 대한 정책도 '통제' 위주에서 '관리'로 변화하고 있다. 이것은 조직범죄가 갖고 있는 약탈 혹은 폭력성을 최소화하면서 적어도 사회가 용인하는 수준으로 조직범죄를 관리하자는 것이다. 동시에 합법화한 조직범죄의 사업이익을 지역사회에 환원하자는 것이다. 이 정책의 밑바탕에는 근본적으로 자본주의 시장원리가 짙게 깔려 있다. 불법이냐 합법이냐를 따지기보다는 조직범죄가 주는 폐해보다는 이익을 우선시하는 입장이다. 조직범죄가 제공하는 재화와 용역을 활용하는 것은 개인의 선택으로 치부할 따름이다. 따라서 조직범죄에 대처하는 법집행기관들은 조직범죄를 강력히 처벌하기도 어렵고 그렇다고 하여 방치하기도 어려운 함정에 빠진 셈이다. 조직범죄의 폭력성과 기생성은 뿌리를 뽑아야 하지만 조직범죄가 제공하는 재화와 용역에 대한 시장은 지역사회에 기여하는 바가 있으므로 사회의 전체적인 맥락 속에서 조직범죄정책이 시행되어야 할 것으로 생각된다.

영문 초록

Organized crimes such as predator and parasite stage are recognized the target of attack and control which they are the root of all social evils. But, criminal organizations such as Mafia and Syndicate are becoming transnational in nature, mobilizing legitimate business resources through international market. These organizations are becoming symbiont with the community. Symbiont organizations are understood as ladder of mobility, patron and protector, and multinational corporate. Changed perspectives are reflected also in the theories. Theories like queer ladder of mobility, ethnic succession theory and enterprise theory came to raise. Furthermore, organized crimes were completely fixed to the community, and organized crimes are seen by one social system, so-called 'organized crime as a community social institution. They say that goods and illegal services by the organized crime compensate the market voids which the community essentially has or organized crimes made intentionally. They say that communities came to accommodate organized crimes since organized crimes became one system of communities and many job opportunities were newly built through a legitimate enterprise or collaboration investment. Because of our basic position that has extended the forcible punishment policy over organized crimes, the appearance of the above changed perspectives and a community social institution theory have given many suggestions and the necessity for discussion. Policies over organized crimes of advanced nations are changing from 'control' to 'management'. It is said that organized crimes will be managed with the level which society admits them. It is very important to minimizes the pillage or violence nature which organized crimes have. It is said that the profits of organized crimes will be returned to the community. This policy aims at a capitalism principle fundamentally. It considers seriously the profit which the organized crime gives. It is individual selection to utilize goods and services which organized crimes offer. Organized crime policies must be enforced in consideration of social overall situations.
