국문 초록

통일의 현실은 다양하기 때문에 그에 따른 통일방안도 다양하게 제시될 수 있다 (조기통일방안, 점진적 통일방안). 통일당사자인 남북한은 현행 헌법 안에서의 통일을 결정할 수도 있지만, 통일현실에 따라서는 현행 헌법을 넘어선 통일을 결정할 수도있다. 따라서 통일에 관한 헌법적 과제를 논할 때에는 특정한 통일현실만을 전제로하여 그에 따른 통일방안에 대한 헌법적 지침과 한계를 논하는데 그쳐서는 안 된다. 헌법상 영토 및 통일관련 규정에 대해 해석을 할 때에도 그러한 해석이 다양한 통일현실과 그에 따른 통일방안을 채택할 때에 어떠한 영향을 미칠 수 있는지를 검토하여야 한다. 또한 다양한 통일방안들에 수반되는 헌법과제들을 해결하기 위해서는 먼저 그러한 통일방안들이 현행 헌법의 틀 안에서 가능한 것인지, 현행 헌법을 넘어서야 비로소 가능한 것인지 여부를 밝히고 나서, 그에 맞는 헌법적 과제의 해결방법(헌법해석, 헌법개정, 헌법제정 방법)을 강구하여야 한다. 마지막으로 통일의 기회를 상실하기 않기 위해서는 남북한 통일당사자들의 통일에의 의지가 강조되어야 할 것이다.

영문 초록

As the unification realities are diverse, the unification formulae depending on them may also be diversely suggested (like prompt unification formulae and gradual unification formulae). South and North Koreas, directly involved in the unification, may decide upon the unification formulae within the current constitution of the Republic of Korea, but they may also do so beyond constitution, depending on the unification realities. Therefore, when we discuss the constitutional Problems concerned with the unification, we should not end up dealing with the constitutional guidelines and limits of the unification formulae in accordance with specific unification realities, assuming only those realities. When we interpret the Territory Clause and the Unification Clause on the constitution, too, we should review what influences such interpretations may have for diverse unification realities - and in case a unification formula is adopted, depending on those realities. And in order to successfully deal with the constitutional Problems accompanying diverse unification formulae, we should first examine if those unification formulae are within the frame of the current constitution, or if they are beyond the frame of the current constitution, and then we may next seek the solutions for the constitutional Problems (such as the solutions for constitutional interpretations and the revision and establishment of the constitution). Finally, lest we should lose an opportunity for unification when such unification reality has come, we should put emphasis on the wills of the parties in South and North Koreas, directly involved in the unification, for the unification.
