국문 초록

이 글은 일제가 조선을 강점 지배하기 전후에 두차례 실시한 국유지조사의 성격을 밝히는데 목적이 있다. 내용은 다음과 같다.첫째, 통감부가 실시한 국유지실지조사와 조선총독부가 실시한 토지조사업의 국유지조사와의 상관성이다. 후자를 시행하기 위해 작성한 국유지통지서의 내용은 전자에서 작성한 국유지대장과 국유지도를 그대로 이기 한 것이었다. 그리고 전자에서 결정된 소유권은 후자의 토지조사사업에서도 부정되지 않고 대부분 그대로 인정되었다. 둘째, 두 조사에서 일어난 국ㆍ민유 분쟁은 대부분 중답주가 주도했다. 일제는 국유지 실지조사에서 중답주를 부정하고 국유지의 소유권에 배타적 권리를 부여했기 때문이다. 사실상의 소유자인 중답주가 자기 권리를 빼앗기자 이에 반발하여 분쟁을 일으켰다. 이때 해결되지 못한 분쟁은 토지조사사업의 분쟁지심사위원회에서 심사하여 결정했다. 김해군과 창원군 토지조사사업의 경우 중답주의 요구는 대부분 받아들여지지 않고 국유로 확정했다. 얼마 안 되는 적은 규모의 토지가 민유로 환급되기도 했지만, 이 토지는 국유지에 혼탈입된 민전이었다. 셋째, 일제의 국유지조사는 수조권에 근거하여 성립한 유토를 배타적 소유권으로 확정하는 작업이었다. 절수사여지는 대부분 국유지로 확정되었다. 국유지실지조사와 국유지조사에서 국유지 설정기준은 동일하였다.

영문 초록

The aim of this thesis is to reveal the purpose of the state land survey proceeded by the Japanese imperialism. The first aim is to find the difference between the state land survey project by the Japanese Residency General and by the Japanese Government General. The contents of the state land notification written by the Japanese Government General were copied from those of the Japanese Residency General. The state land survey project of the latter almost acknowledged the ownership decided by the former without any question. The second, the ownership dispute between nation and people was caused by the intermediary land ownership. The Japanese imperialism denied the intermediary land ownership of the state land survey project and granted exclusive right to the state land ownership. The intermediaries, real land owners repelled this action and provoked a dispute. This kind of dispute was caused greatly at the time of the land survey project. However, the land survey project of Changwon-gun and Gimhae-gun didn't accept the demand of intermediaries. At that time, the land changed into individual ownership was mixed with the state ownership. The third, the aim of the state land survey project by the Japanese imperialism was to change the state land established by the right of taxation into exclusive ownership. Therefore, the land granted by the king was mostly changed into the state land.
