국문 초록

현재 한국에서도 다문화라는 이름으로 수많은 외국인들이 체류하고 있고, 더 나아가 한국에 정착하고 있는 그들의 2세-그들도 그들의 모국어를 모르며, 돌아갈 생활의 근거지도 없거나 돌아갈 수 없는-는 한국 속의 영원한 이방인인가 아니면 한국 속의 시민으로 살아갈 수는 없는 것일까? 한편 일본에서 재일 코리언은 일반적으로 한국인이면서 일본에 재류하고 있는 사람을 통칭하기도 한다. 그런데 이와 상대적인 개념으로 '코리안 저패니즈(Korean Japanese)'란 일본으로 귀화한 한국인을 의미하기도 한다. 여기에는 국적이란 이름으로 이들이 구분되고 있는 것이다. 즉 이들은 민족적으로는 한국인이고, 국적으로는 일본인이다. 그러나 해방 이전부터 일본으로 건너갔던 이들이 이제는 재일 교포 5세가 되는 시점이다. 이들은 이름은 재일 교포인데 한국에는 생활의 근거지도 없고 한국어도 할 수 없는 이들이 많은데, 귀화하지 않은 나머지 교포들의 일본에서의 정체성은 어떻게 이해하여야 할까? 국적과 국가구성원의 관계를 어떻게 설정하여야 할까? 그들은 일본의 국가구성원으로서의 자격은 없는 것일까? 한 국가에 5세대가 되도록 체류하였으며, 조국이란 이름으로 돌아갈 수 있는 생활의 근거지가 없는데도 그들은 일본 속에서 영원한 이방인인가, 아니면 일정 부분 세금을 내고 사는 일본 속의 시민으로서는 살아갈 수 없는 것인가? 이미 유럽에서도 유럽연합이 형성되면서 통합과 지역화가 동시에 대두되면서 국민ㆍ국적에 대한 새로운 개념 모색과 더불어 참가민주주의 등이 국적과 분리된 새로운 주권이론의 변화가 이동 중심의 「새로운 시민권」(nouvelle citoyenneté)이란 개념으로 형성되고 있기도 하다. 이러한 현실적인 의문점들이 국가와 국가구성원의 관계, 오늘날 일반화되어 있는 국민주권이란 이론과의 연계성은 어떻게 구성할 것인가, 아니면 시민주권이란 이름으로 재구성해볼 수 있는가 하는 점에 초점을 맞추며, 이러한 문제의 해결점을 찾고자 하는 것이 본 논문의 목적이다.

영문 초록

Currently a great number of foreigners are staying in Korea by the name of multi-culture. The 2nd generations of those people who are settling down in Korea neither know their native language nor find any source of life to return to or afford to return. Are they eternal foreigners in Korea or can't they live as citizens of Korea? Korean Japaneses are known as people who are Koreans and reside in Japan. As a contrary concept to this, on the other hand, they refers to Koreans who become naturalized in Japan. Inferrible herewith, they are differentiated in view of nationality. In other words, they are Koreans ethnically and Japaneses in nationality. By the way, time has meantime passed by in a way that the people who went to Japan since before liberation of Korea from Japan are now replaced to the 5th generations of Korean Japaneses. While there are many people who are Korean Japaneses by their names but have neither source of life in Korea nor can speak Korean, how do we understand the identities of the rest Korean Japaneses who do not choose to become naturalized in Japan? How do we create a relationship between Nationality and Members of Nation? Aren't they qualified as members of nation in Japan? Having stayed in a country up to the stage of 5th generation but finding no source of life to return to by the name of homeland, are they eternal foreigners in Japan or can't they live as citizens of Japan while duly paying certain portions of taxes? As the foundation of European Union has already propagated integration and localization in Europe at the same time, new concepts are being seeked for Nation & Nationality and also the new change in sovereignty theory, where democratic participation is separated from nationality, is emerging as a concept of movement-oriented "New Citizen Right(nouvelle citoyenneté)" as well. Putting its focus on how these practical questions create a relashionship between Nation and Members of Nation, construct linkage to the theory of national sovereignty generalized these days, or whether these can be reconstructed by the name of citizen sovereignty, this study aims at finding a solution to thereby arising problems.
