상대적 평등설의 허구성

국문 초록

'평등'의 개념에 관한 문제는 늘 상대적 평등과 절대적 평등을 대비시켜 두고 논의되어 왔다. 그런데, 상대적 평등설은 하나의 내용을 가진 학설이 아니다. 크게 보더라도, 두 가지 이질적인 내용을 가지고 있다. 즉, 절대적 평등의 개념 요소인 '절대적', '같음' 중 각 하나씩을 부정한 후, 자신의 견해를 상대적 평등이라 할 뿐이다. 평등을 합리적 차별을 허용하는 것이라 보는 입장은 '절대적' 부분을 부정한 상대적 평등설이고, 같은 것은 같게, 다른 것은 다르게 처우하는 것이라 보는 입장은 '같음'을 부정한 상대적 평등설이다. 그런데, 전자는 평등의 의미에 관하여 아무런 의미가 없다. 평등이 무엇을 요구하는가를 말하지 않고, 차별의 정당화 여부에 대해서만 말하기 때문이다. 후자는 평등의 의미를 밝히는 데 있어서는 의미가 있으나, 실천적으로는 동등한 처우가 헌법에 의하여 명령되는 것으로 보는 것과 같은 내용의 심사를 한다. 다른 처우가 있다고 하여 바로 차별이 있다고 보는 것은, 후자의 논리적 귀결이 아니다. 이와 같은 혼란은, 법집행의 평등과 입법자 구속설을 오해하고, '명령'과 '허용'을 혼동함으로써 생긴 것이다.

영문 초록

1. Those who uphold the relative equality theory (RET) understand absolute equality as treating things the same. They claim that RET is reasonable, as it is impossible and unreasonable to guarantee absolute equality. 2. What the relative equality theorists say about the content of relative equality is twofold. One is to allow reasonable discrimination (RET-1), and the other is to treat the same things the same way and different things differently (RET-2). 3. However, RET-1 is in reality the same as the absolute equality theory (AET), as its proponents have the same idea of what the Constitution commands. RET-2 can be understood to be opposed to AET because its proponents have a different idea of what the Constitution commands. 4. According to RET-2, even if there is different treatment, we cannot say this is discrimination, as we have not determined whether the case involves the same things being treated differently, or different things being treated differently. Only when we accept RET-1 can we immediately determine that it is discrimination to treat things differently. Almost always in judicial review, RET-1 is accepted. However, RET-1 is the same as AET. 5. Even though relative equality theorists facially reject AET, in terms of content their idea is identical to AET (RET-1), or they fail to follow the logic of their unique idea (RET-2). Accordingly, RET is fictional.
