지방자치단체의 사무와 조례제정에 관한 판례검토

국문 초록

본 연구는 대법원 2013.4.11. 선고 2012추22판결(조례안재의결무효확인)을 대상으로 지방자치사무와 관련하여 조례제정권의 범위와 한계문제를 검토한 것이다. 이 판례는 화천군의회가 '화천군 관내 고등학교 학생 교육비 지원 조례안'이 집행기관인 지방자치단체장의 고유재량권과 예산배분순위 결정권을 침해하였다고 주장하나 대법원은 수업료, 입학금 지원에 관한 사무는 지방자치법 제9조 제2항 제2호의 주민의 복리증진에 관한 사무로 지방자치단체의 고유사무에 해당하므로 조례제정이 가능하다고 판단하였다. 일반적으로 학설과 판례는 조례제정사무로 지방자치단의 사무 중 자치사무와 단체위임사무에 한하고, 기관위임사무는 제외하고 있다. 따라서 화천군의회가 의결한 조례안은 수업료, 입학금 지원에 관한 사무를 규정한 것으로 지방자치사무 중 자치사무에 해당하여 조례제정이 가능하다고 할 수 있다. 그렇다면 이 사건 조례안이 위법하지 아니하다는 대법원의 판례는 타당하다고 본다. 본 연구에서는 대상판결을 평가하고 그에 대한 법적 쟁점으로 지방자치단체의 사무유형, 조례제정권의 범위와 한계 등을 검토하고 있다.

영문 초록

This study is about the review of a case law in affairs of a local government and the limit of enactment of power of municipal ordinance. By section 117 of the Constitution of Korea, regional governments have limited autonomy and legislative powers to create by-laws. In practice, such powers are exercised in accordance with the Regional Autonomy Law. In terms of its mandatory powers and effective, it is considered the lowest of all legislation possible. The objective of this study is the Supreme Court Case 2013.4.11. 선고 2012추22 판결. There are three parts in autonomous affairs, which are autonomous affairs, collective delegated affairs and agency delegated affairs. The objective of enactment of power of municipal ordinance is the autonomous affairs and collective delegated affairs, and the agency delegated affairs are not the objective of it. The content of this case is the enactment of the ordinance bill of the support of education fee of the high school in the county of Hwachun', which is paying a tuition fee for excellent students. It applies to affairs of the welfare improvement of residents. Therefore the Supreme Court judged affairs of paying a tuition fee for excellent students applies to affairs of the autonomous affairs, and the local council of Hwachun County has an enactment power of municipal ordinance about that. In connection with this Supreme Court case, this paper reviewed affairs of a local government and enactment of power of municipal ordinance.
