법과대학에서의 법학교육의 방향

국문 초록

우리나라의 로스쿨은 우여곡절을 거쳐 2009년 3월에 개원되었지만, 출범직후부터 지금까지 적지 않은 문제점들로 인해 시행착오를 거듭하고 있다. 최근에는 그 존폐문제까지 거론되며 치열한 논쟁의 소용돌이 속에 빠져 있다. 로스쿨은 우리 사회가 선택한 하나의 실험적인 제도에 해당되기 때문에 초기의 시행착오는 어쩌면 당연한 것일 수 있다. 그러나 출범한 지 5년이 지난 지금 로스쿨은 당초 도입 취지에 비추어 역행하는 측면이 크고, 지금 드러나고 있는 문제점들은 현재의 로스쿨 운영체제로는 치유하기가 어려운 본질적인 문제들에 해당한다는 지적이 설득력을 얻고 있다. 이에 현행로스쿨 제도의 부족한 점을 보완하는 기능을 수행하면서 로스쿨이 폐지되더라도 새로운 제도가 마련될 때까지 징검다리 역할을 해줄 수 있는 변호사예비시험(이하 "예비시험"이라 함)을 도입하여 운영하는 것이 타당하지 않을까 생각된다. 예비시험과 관련한 운영은 일정한 인적ㆍ물적 요건을 갖춘 법과대학에서 담당하는 것이 효율적일 것으로 본다. 일본의 예비시험과 유사한 예비시험을 도입할 경우에 예비시험에 응시할 수 있는 자격을 정하거나, 미국 캘리포니아 주의 'baby bar'와 유사한 예비시험을 도입할 경우 예비시험의 응시자격요건과 예비시험 합격 후 대체교육기관(또는 의무법학교육기관)을 정할 때 법과대학으로 하여금 그 역할과 기능을 담당하도록 하는 것이 필요하다고 본다. 한편 법과대학에서는 로스쿨 도입 이전부터 90% 이상의 졸업생이 법조계 이외의 분야로 진출해온 점을 중시여겨 이를 위한 대책을 보다 근본적으로 수립하는 것이 필요하다. 이를 위해 우리 사회에서 법률수요가 요청되는 일정 기관이나 기업을 위해 맞춤형교육을 실시하는 방안을 적극 모색해볼 필요가 있다. 특히 지방 법과대학의 경우 같은 지역에 거점을 둔 일반 사기업, 공기업 또는 금융기관 등과 다양한 접촉을 통해 협약을 체결하고 효과적인 기업맞춤형 프로그램과 교과과정 프로그램을 개발하여 맞춤형교육을 실시하는 방안을 모색해 보아야 할 것이다. 위와 같은 변호사예비시험과 관련한 교육이나 기업맞춤형 교육은 법학교육인증제를 통해 보다 효과적으로 시행할 수 있을 것이다. 이제 법학교육의 정상화를 위해 겸허하게 법조계, 로스쿨협의회, 한국법학교수회, 대한법학교수회, 법과대학협의회 등의 유관기관들이 머리를 맞대고 이 모든 것에 관하여 진지한 논의와 검토를 해야 할 때이다.

영문 초록

Law schools in Korea opened in March, 2009 through a lot of controversy and pain. Universities which opened law schools stopped recruiting new students in their departments of law from 2009 and in 2018, it will be completely abolished and the law schools will be left. However, colleges of law, which were not permitted to open law schools, have maintained bachelors' programs in law. The opening of law schools has been somewhat pessimistically considered. It was expected that the colleges of law would challenge their necessity or continuance, and the number and level of students who attend colleges of law which can not produce lawyers will remarkably deteriorate. Actually, colleges of law have had serious problems as they were reduced to being targets of reorganization since the opening of the law schools. As the law schools have also gone through trial and error, the issue of maintenance or abolition has been fiercely debated. Such a debate is about whether to continue the law school system as it was planned before the abolition of the national judicial examination in 2018, to introduce a preliminary law examination system or to have a dual system producing law professionals while maintaining the national judicial examination. With this in mind, this study aimed to look at recent debate on what is happening in circles of law, politics, and legal sciences before the abolition of the national judicial examination, and then present future directions for legal education at colleges of law focusing on the law education authorization system as a new educational method. The authorization system can be considered from several aspects: When a preliminary lawyer examination is introduced, when the qualifications of the applicants are decided, or alternative educational institutes (compulsory law educational institutes) are decided after students pass, as an alternative to law schools after they are abolished, and when customized education is given for different jobs. Now is the time when institutes and organizations concerned including legal circles, the law school council, the Korea Law Professional Association, the Daehan Law Professional Association, and the Law Collage Association should examine the situation and hold serious discussion.
