헌법과 노인교육

국문 초록

헌법 제31조는 "모든 국민은 능력에 따라 균등하게 교육을 받을 권리를 가진다."고 규정하면서, 학교교육과 평생교육 등에 대하여 규정하고 있는데, 여기에서 노인교육의 헌법 직접적 근거를 찾아볼 수 있다. 노인교육은 노인욕구의 질적 변화(생존욕구로부터 자아실현 욕구), 평생학습사회의 도래, 급속한 사회변화, 세대 간 이해의 필요성(세대 분리 교육으로부터 세대 통합 교육) 등의 요청에서 그 필요성을 찾아 볼 수 있다. 노인교육이란 노인의 교육욕구를 충족시키고 그들의 지혜를 후손에게 전수하며 사회발전에 기여하고 참여할 수 있는 기회를 제공하여 노인 스스로가 자신의 삶을 실현해 갈 수 있는 장을 마련해주는데 그 의의가 있다. 이를 위해 노인교육의 과정에서는 자발성의 원리, 경로의 원리, 사제동행의 원리, 생활화의 원리, 사회화의 원리 등이 준수되어야 한다. 노인교육은 '노인을 위한 교육'과 '노인에 관한 교육', 그리고 '노인에 의한 교육' 모두를 포함하는 넓은 개념으로 이해될 필요가 있으며, 이러한 것들의 공유지점을 "세대공동체 교육(intergenerational education)"이라 부를 수 있을 것이다. 현재 노인교육 관련 법률로는 노인복지법, 평생교육법, 저출산ㆍ고령사회기본법 등이 있다. 노인대학이라는 명칭을 법제화할 필요가 있으며, 노인교육을 실질적으로 포함할 수 있는 평생교육이 되도록 법적 보완이 이루어져야 한다. 그리고 노인교육 전반을 담당하는 행정부서를 단일화하거나 부서 간 협조채널을 마련할 필요가 있으며, 노인교육에 대한 인식 제고 노력이 필요하다고 생각한다.

영문 초록

Enacting Article 31 of the Constitution "all citizens shall have an equal right to an education corresponding to their abilities", also school and lifelong education etc. Here we can find direct grounds of constitution about elderly education. Necessity of elderly education is directly traceable to request of 'qualitative change of desire of elderly', 'the advent of lifelong learning society', 'rapid change of society', 'the need for a mutuality of understanding between generation'. Elderly education has a signification arranging for themselves a place for realizing their life, satisfying education desire of elderly, handing down their wisdom to descendants, by providing opportunity which contributing and participating to social evolution. For this, curriculum is to be observed principle of spontaneousness, respect for the elderly, companion of teacher and pupil, familiarization, socialization and so on. Elderly education must be understood to extensive concept which all contain-education for elderly, education about elderly, education by elderly-, and we can denominate these sharing point as "intergenerational education". Currently, laws about elderly education are 'Welfare of the Aged Act', 'Lifelong Education Act', 'Framework Act on low fertility-aged society'. I strenuously insist that legislation of 'university of an aged'-name, legal supplementation of lifelong education-elderly education materially is contained-, unification of administrative department overall treat elderly education or arrangements of cooperation channel of interdepartmental, effort for awareness-raising about elderly education.
