인터넷 신상털기와 관음적 심리

국문 초록

신상털기란 최근의 합성단어로 '신상(身上)'과 '털기'의 합성어로 특정인의 신상 관련 자료를 인터넷 검색을 이용하여 찾아내어 다시 인터넷에 무차별 공개하는 형태로 나타나기 때문에 사이버 폭력을 넘어서 사이버 테러로 정의할 수 있다. 이러한 신상털기는 정신분석학에서 정의하는 관음적 심리에서 시작된다. 단순히 인터넷상에서의 공개지만 현실과 사이버공간의 경계가 희미한 지금 신상정보 유출은 심각한 사회문제로 대두되고 있다. 대부분의 경우 신상정보가 유출되는 경로는 인터넷 검색 엔진을 통해서 이루어지고, 스마트폰의 대중화로 인해 트위터나 페이스북 등과 같은 SNS를 통해 전파되고 있다. 이러한 행위들을 시도하는 사람들은 일상화된 놀이문화로 생각하지만, 명백한 것은 「정보통신망법」에 위배되는 범죄라는 것이다. 신상털기의 원인은 네티즌들의 왜곡된 공명심, 인터넷 포털사이트의 검색기능과 SNS의 발전, 사이버공간에서 쌍방향 의사소통의 역할을 하고 있는 댓글 문화, 언론과 수사기관의 범죄보도에서 일정 부분 신상털기의 원인을 제공하는 역할도 하고 있는 것이다. 신상털기로 인한 여러 가지 피해사례들에서 나타나는 문제점들을 보면, 범죄피해자든 가해자든 상관없이 신상털기를 자행함에 따라 돌이킬 수 없는 피해 및 2차 피해를 겪게 되거나, 동명이인들이 피해를 받는 사례들이 문제점으로 나타나게 된다. 또한 신상털기라는 것이 놀이문화로 여겨지기 때문에 사건이 발생하게 되면 일상적으로 신상털기를 하게 되면서, 신상털기가 일상화 되어가는 문제점들을 가지고 있다.

영문 초록

The compound word 'exposure of personal affairs is formed from the words ''Sinsang'(personal information) and 'Teolki'(profiling). exposure of personal affairs could be defined as cyber terrorism because netsurfers research personal data of specific person through exploring internet, then post those information without any attention to web. Recently the boundaries of reality and cyberspace becomes increasingly blurred so releasing specific identity on internet constitutes severe social problems. Mostly the routes of leaking the information are through the internet search engines, then the data become widely disseminated through Social Networking Services such as the Twitter or the Facebook. Since most people uses smartphone, web users who try to expose personal affairs consider the behavior as a generalized entertainment, however, it patently is a crime which violates the Information Communications Network Act. Distorted ambition of web users, advanced searching function of internet and SNS, reply culture for mutual communication in the cyberspace, and crime report by the media or the investigation agency contribute to offer fundamental causes of exposure of personal affairs. Firstly, when web users who probe and bruit both criminals' and victims' data on the internet, several cases of exposure of personal affairs might lead to secondary matters. Also different person with same name could be a victim of the defamation in cyberspace. Lastly, the exposure of personal affairs has been considered as a kind of entertainment culture. Whenever a crime is reported, tracing and posting identity on net becomes routinary procedure to the public. a perversion in which a person receives sexual gratification from seeing the genitalia of others or witnessing others' sexual behavior
