국문 초록

최근 공익사업으로 손실보상합의가 되지 아니한 토지 등에 대해 공용수용이 증가함에 따라 이주대책을 둘러싸고 집단민원이 발생하여 사회적 문제가 발생하고 있다. 본 논문은 공익사업 보상현장에서 공용수용에 직접 영향을 미치는 변수가 무엇인지를 파악하여 실증적ㆍ정책적 시사점을 제시하는 한편 공익사업 효율성을 높이기 위함이다. 연구수행을 위해 「중앙토지수용위원회」및「대전광역시지방토지수용위원회」수용재결 실태를 분석하고 공익사업 실무담당자(대전시청 및 구청 보상담당자) 및 피수용자들을 대상으로 설문조사 한 후 AMOS 경로분석을 통해 공용수용에 미치는 영향과 요인을 분석하였다. 분석결과 공용수용에 직접적인 영향을 미치는 변인으로는 법률적요인 하위항목‘부동산 상속불가’,‘무주부동산’,‘행방불명’으로 나타났다. 반면 토지수용에 영향이 클 것으로 기대했던 개별요인, 개발방식, 보상평가, 행정적 요인들은 분석결과 수용에 직접적으로 영향을 주지 않는 것으로 나타났다.

영문 초록

As compulsory expropriations for the land where compensation for loss has not been settled due to public services has currently been increasing, social issues have arisen from collective civil complaints appeared with regard to emigration measures. This thesis is to suggest empirical/strategic implications by comprehending variables directly affecting compulsory expropriations at the scene of compensation for public services and to increase the number of settlements of compensation for public services. To perform a research, the actual state of expropriations adjudicated in Central Land Tribunal and「Daejeon Local Land Tribunal」were analyzed and a survey targeting practitioners engaged in public services (People in charge of compensation in the borough office and in Daejeon City Hall) and expropriated people was conducted and the effects on compulsory expropriation and the satisfaction level by factors were then comprehended through AMOS path analysis. As a result of an analysis on factors of compulsory expropriations, for empirical implications, it showed ‘not being subject to an inheritance of properties’, ‘ownerless properties’ and ‘missing’ for subcategories of legal factors as a variable directly affecting compulsory expropriation. However, individual factors, development methods, compensation appraisals and administrative factors which were expected to have the greater effect on land expropriation appeared not to carry a directly affect.
