공용수용의 감정평가에서 소유자추천제에 대한 경제적 분석

국문 초록

우리나라에서는 공용수용 과정에서 피수용자의 권익을 보호하고, 수용자와 갈등해소의 일환으로 2003년부터 일정조건하에서 감정평가업자의 소유자추천제가 시행되고 있다. 이 제도의 공과에 대하여 많은 논의가 있어왔지만, 본 연구는 제3자적 시각에서 접근을 시도하였다. 먼저 이론모형을 설정하였는데 소유자추천제에 따른 보상가격산정의 주체인 감정평가업자와 피수용자 및 수용권자 사이의 유인체계(incentive system)가 어떻게 변화할 것인지 예측해보았다. 다음으로 소유자추천제가 궁극적으로 수용의 진행과정에서 발생하는 거래비용(transaction cost)을 감소시켜 경제효율성을 증가시킬 수 있는지 여부를 실증분석 하였다. 이를 위해 협의보상과 수용재결 등의 신청여부를 비교하였는데 피수용자의 불만족한 정도를 측정하기 위해서였다. 결과적으로 이론적 검토에서 소유자추천제는 수용권자와 피수용자간의 기대보수가 증가하여 합의(협의) 가능성을 높이는 것으로 분석된다. 또한 실증분석 결과보상금액 자체는 증가하나 수용재결은 감소시켜 거래비용 측면에서만 본다면 소유자추천제가 경제적 효율성을 증가시켰다고 판단된다. 이러한 일련의 과정을 통해 본고는 공용수용과 관련된 논의들을 자원의 효율적 배분측면에서 접근할 수 있는 가능성을 제시하고자 하였다.

영문 초록

The owners recommendation system of real estate appraisal has adopted for dissatisfactory solution and protecting shareholders right of owners in public takings process since 2003. There has been the pros and cons of the owners recommendation, this study was attempted started an outsider's perspective. Firstly, prediction of incentive system between prospect appraisers who have evaluation rights and landowners, between prospect appraisers and takings institution. Secondly, it was data analysis whether enhancing the efficiency of the economy through reducing transaction cost of takings process. For this, dissatisfactions degree of landowner were evaluated by consultation indemnification and takings appeal. The result of this study was as followed. The mutual agreement between owners and takings agency was widely expected because expected revenue of both sides increased. The owners recommendation system was enhanced the efficiency of the economy in view of reducing transaction cost through increasing the amount of compensation. Consequently, this paper was produced the possibility of effectively proceed approach in the process of takings.
