국문 초록

비범죄화에 관한 논의는 다양한 각도에서 접근할 필요가 있다. 그것은 법적인 관점에서 국가형별권의 약화를 가져올 수 있다는 두려움이나 위법행위의 증가를 가져올 수 있다는 소극적이니 자세로 접근되어서는 안 되며, 그 반대의 경우도 경계하여야 한다. 비범죄화에 관한 접근은 통합적 관점에서 이루어져야 할 필요가 있으며, 그것은 사회 범죄통제 능력의 한계와 범죄에 대한 사회적 인식이라는 측면에서 접근되어져야 한다는 것이다. 그동안 범죄의 종류와 그에 대한 형벌은 과도한 비대화로 말미암아 윤리적.개인적 영역까지 침투하게 되었고 이러한 결과 오히려 사회적 손실을 가져오는 측면까지 발생하고 있다. 시민의 안전을 위협하는 강력범죄와 테러는 증가하고 있지만 이에 투입될 형사사법 역량은 한정되어 있다는 점이다. 비효율적인 형사사법비용과 인력의 투입을 사회안전을 위협하는 강력범죄 대처에 전환시킬 수 있다면 좀 더 안전한 사회의 유지를 기대할 수 있을 것이다. 때문에 우리가 대승적 관점에서 비범죄화를 논의하고 수용할 수 있다면 형사사법기관의 효율적 활용, 강력범죄로부터 좀더 안전한 사회 건설, 형사사법기관의 탈권력화 및 경량화, 범죄에 대한 사회적 인식의 합의와 국가통제에 대한 신뢰 확보, 준법정신과 윤리의식의 제고 등의 효과를 거둘 수 있을 것이다. 범죄에 대한 통제는 법리와 효과를 감안하여 결정될 문제이지만 윤리문제에 대한 통제와 개인의 사적영역에 대한 국가기관의 관여보다는 실질적으로 사회안전을 기하고 취약계층을 범죄로부터 보호할 수 있는 방향으로 전환되어져야 할 필요가 있다.

영문 초록

A discussion on decriminalization needs be approached from various view points. It should not be dealt with the fear of weakening the nation's rights of punishment, or with the passive standpoint of considering an increase in illegal acts. At the same time, the opposite standpoint should also be taken with caution. The approach to the subject of decriminalization needs to be performed from thesocial perspective. In other words, it should be approached in the aspect of a social limit of crime control and social consensus. In the past days, the types of crime and the excessive punishment associated with them, have invaded the ethical and personal realm, and that has caused more social damage in some aspects. Violent crime and terror that threatens citizens' safety are increasing, but the criminal justice enforcement capacity is limited. If we can redirect the cost and the human resources, which have been used for inefficient criminal justice enforcement, to the prevention of violent crimes, we may able to maintain better safety in our society. Hence, if we can discuss and accommodate the subject of decriminalization from a broad view, it will be possible for us to achieve the efficient utilization of criminal justice institutes, the establishment of a society that is safe from violent crime, the deauthorization and downscaling of criminal justice institutes, the drawing of a social agreement on crime, the regaining of trust in the nation's controlling capability, and the boosting of a law-abiding spirit and ethical awareness. Although control over crime should be determined considering various perspectives and effects, it should be done in a way which social safety can be secured and socially isolated people can be protected from crime, rather than in the way in which ethical realm is invaded and national institutes are involved in citizens' private domain.
