아동 대상 성범죄자의 범죄심리학적 특성에 관한 고찰

국문 초록

아동 대상 성범죄사건은 범행의 잔혹성과 파렴치함으로 인해 국민들의 분노를 불러일으키며, 범죄두려움을 가중시켜 최근 심각한 사회문제로 떠오르고 있다. 따라서 이 연구에서는 아동 대상 성범죄의 근본적인 대책마련을 위한 과정으로 전국종합일간신문에서 2009년 8월부터 2010년 7월까지 보도된 주요 아동 대상 성범죄사건 기사를 중심으로 성범죄자의 범죄심리학적 특성을 분석하여 실효성 있는 대책을 모색하는데 목적을 두고 있다. 분석결과, 아동 대상 성범죄자는 다양한 연령대를 보였으며, 직업은 단순노무직이나 무직상태가 대부분이었다. 범죄경력을 살펴보면, 유사 및 동종전과, 정신질병적 전력 등이 나타나 재범의 우려를 보여주었다. 피해아동은 7세에서 13세 사이의 여아가 많았고, 성범죄유형은 강간 및 강제추행의 형태를 취하였다. 특이한 사항은 범죄자 및 피해자의 주거지역 주변에서 범행하는 경향이 있어 대담성을 엿볼 수 있었으며, 피해자와 가해자의 관계에 따라 범행장소에 차이점이 발견되었다. 범행수단으로 유인이나 폭력을 사용하였고, 대부분 치밀한 계획을 세우고 범행을 저질렀다는 공통점이 나타났다. 또한 발달의 미성숙과 부적절한 감정조절 등의 문제로 인해 범행을 저지르게 되며, 사회생활의 부적응 등에 직면하면서 이에 대한 불만을 나약한 아동에게서 해소하려는 경향이 있었다. 극소수의 경우였지만 아동기 때의 성적 학대 경험 또한 성범죄를 저지르는데 있어 중요 요인으로 작용하였다. 따라서 아동 대상 성범죄사건의 분석결과를 종합해보면, 어린 시절의 환경, 결혼 및 사회생활, 정신질병적인 문제 등의 요인이 복합적으로 작용하여 발생되는 것으로 나타났다. 따라서 위 분석결과에서 보여 지는 아동 대상 성범죄자의 특성을 고려하여 그들에 대한 철저한 관리를 통한 재범방지, 피해아동에 대한 지원, 성범죄예방을 위한 교육, 관련 기관들 간의 연결망 구축 등의 방안을 마련해야 할 것이다.

영문 초록

Sex crimes against children stir utmost resentment among the public and increase fear for crimes due to the cruelty and brazenness of the crimes themselves, thus emerging as serious social issues in recent years. Thus this study reviewed article about sex crimes against children in national daily newspapers from August, 2009 to July, 2010 and analyzed the criminal psychological characteristics of the offenders as part of the process of preparing fundamental countermeasures against sex crimes against since feasible countermeasures can only be prepared through accurate analysis and understanding. According to the analysis result of the crimes, the sexual offenders against children widely varied in age and mostly either engaged in simple labor or were unemployed. Their criminal histories caused concern for second offenses, laced with similar or the same kind of previous convictions and mental disorders. The child victims were usually girls aged from 7 to 13. The types of sex crimes against the children were rape and indecent assault in many cases. What was noteworthy about the places of crimes was that the crimes tended to take place near the residence of offenders or victims in a hold fashion. There were differences in the places of crimes according to the relationships between offender and victim. The offenders used either allurement or violence as a means of crime, and most of them devised thorough plans before actually committing them. When social attention is concentrated on sex crimes against children, people get upset and demand for tougher punishment. Once the public interest fades away, however, various countermeasures fail to get implemented in many cases. Thus it is critical to consider the characteristics of sexual offenders against children described above and to devise a range of plans including prevention of second offenses through thorough monitoring, support for child victims, education on the prevention of sex crimes, and a network of related organizations.
