从婚姻的概念看中国婚姻的现状与法律

국문 초록

작자는 혼인의 정의로부터 시작하여, 동성애, 사실 혼인과 동거와 같은 중국의 현상과 관계있는 법률조정 중점적으로 분석하고 지적하고 있다. 동성애는 중국 대륙에서 점차 형상화되는 과정에서 병리화되는 현상을 나타내었다. 대다수의 사람이 동성애에 대해서 결코 인정하려하지 않기 때문에, 일부의 학자들은 개별적인 집단 즉, 동성애 집단의 법률적 권리 쟁취 노력이 사회적인 호응을 얻을 수 없다고 한다. 현재에 이르러서도, 중국은 동성 관계법이 없고, 최근에도 입법할 계획이 없지만, 조만간 동성애의 확산과 민중의 생각변화로 보아 입법이 필요하고 생각된다. 혼인 문제가 철저히 해결되려면, 입법 기관을 통하게 함으로써 전통 혼인풍습과 단절되는 것을 막아야 한다. 또 법률을 제정하여 사상적으로 민족의 전통 가치를 존중하고 민족의 역사적인 경험과 지혜를 바탕으로 결혼식 문화를 구축하여 법률 위에서 정당성과 합법성을 가지도록 해야 하며, 혼인 신고를 확립하여, 혼인의식을 보충적인 제도로 확립해야한다. 동시에 나날이 증가한 혼인이 아닌 목적상의 동거가 진행되는 것에 대해 입법의 조사와 연구 실시를 필요로 한다. 이러한 사실로 생각해 본다면 중국 혼인의 개념은 미래에 일정한 변화가 있을 것이라 생각된다.

영문 초록

Based on the definition of marriage, the author mainly analyzed the present situation in China on homosexuals, factual marriage and cohabitation as well as the related legal regulation, and pointed out that Mainland China has experienced non-criminal, non-pathological and gradual humanized progress in homosexuals. However, due to the disagreement of the majority of people on homosexuals, the efforts to win legal rights for this group by some few scholars have not been responded among society. Until now, China has made no law on the civil partnership; neither had she any intention to make one in the near future. The future legislation depends on the development of homosexual love and the moral sense of the public. As for the complete solution to the problem of factual marriage, legislature should cast away the improper proceeding of separating from the traditional marriage customs, respect the traditional value of his own people on the guidelines of legislation, legally recognize the legitimacy and the legality of those marriage ceremonies built on past experience and wisdom, and establish a system that ensures the leading role of marriage at a registry and supplemented by marriage ceremony. At the same time legislature needs to carry out legislative investigations and studies on the growing number of non-marital cohabitation. From this point of view, we may expect a certain change in the connotation of the marriage concept in China in the future.
