新聞話語中的民初律師

국문 초록

辯護士는 비록 서양 법률제도의 배경 하에서 만들어진 직업이기는 하나 현재 중국에서 없어서는 안 되는 직업이 되었다. 그러나 일반 서민들에게 변호사 직업에 대한 수요가 더욱 많아졌지만 변호사에 대한 시각은 여전히 논란이 있으며, 심지어는 사회적 화제가 되기도 하였다. 이와 같은 문제에 비추어 본문은 중국 본토에서 변호사 직업이 언제부터 나타나기 시작했는가를 기초적인 발전을 가져온 민국초기에 초점을 맞춰 연구하고자 한다. 民國初期에 중국의 新聞業은 발전하였고, 아울러 유례없는 신흥전파매체로 성장했다. 이 매체는 뉴스전파의 경로와 규모를 변화시켰으며, 여론공간을 형성하여 여러 가지 사상의 표현과 교류의 장을 제공하였다. 申報는 근대 중국에서 가장 오랫동안 발간되었으며, 가장 영향력이 컸던 언론매체로써 본문의 연구에 풍부한 자료를 제공하였다. 본 문은 언론매체의 시각에서 출발하여 공공여론의 맥락에서 민국초기 변호사의 이미지, 지위, 사람들의 변호사에 대한 시각 및 변호사의 발전 특징 등에 대해 살펴보았다. 한편으로 당시 사회의 주류 시각이었던 舊習을타파하고, 서양의 政治法律制度를 학습 하고자는 추세의 영향으로 변호사들은 자신들을 홍보하는 대표적인 화두로서 人權保護를 내세웠다. 그리고 당시 국가가 빈약하고 司法主權이 침해당하는 상황에서 변호사와 변호사 노조 등의 단체들은 사법주권의 개혁과 권익수호 활동에 적극 참여함으로써 法治건설 에 어느 정도 기여를 하였다. 변호사들의 활동 상황은 언론매체를 통하여 일반 서민들에게 전달되어 서민들의 민중의식 고양에 적극적인 역할을 하였다. 다른 한편으로 변호사업의 발전 초기에 변호사업종에 대한 관리가 미비하였고 변호 사의 자질은 낮았지만 수입이 높아 서민들에게 나쁜 인상을 남기기도 하였다. 그리고 서민들은 중국의 전통적인 법률문화의 영향으로 변호사도 訟師와 마찬가지로 黑白을 顚倒하고 경제적인 이익만 추구하는 부류로 인식하여 변호사에 대해 惡意的이고 不信任하는 태도를 보이기도 하였다. 이외에 변호사의 기능에 대해서도 일부 부정적인 시각을 갖고 있었다. 본 문은 언론매체에 대한분석을 통하여 당시 사람들이 가지고 있었던 변호사에 대한 모순적이고 다양한 시각을 통해 중국 본토의 변호사 직업이 점차 발전하였고 커다란 사회적 영향력을 주었음을 발견하였다.

영문 초록

Although lawyers are derived from western legal systems, it is indispensable in present China. However, as ordinary people's demand for lawyer grows, opinions of lawyer are still controversial which always become hot topic in the community. In view of the concern on this issue, this paper will pay attention to the early period of Republic of China when local Chinese lawyers emerged and professional legal service initially developed, expecting to provide historic reference to current issue. In early Republic of China, Chinese publishing industry had developed to a certain degree and newspaper had become unprecedented new media. Modern newspaper changed the approach and scale of dissemination of news and formed a pubic space as a common platform for expression of ideas and exchange of information. Shenbao, the longest- existed and influential newspaper in modern China, provides a wealth of information and materials for this research. From the viewpoint of the news medial, this paper studies subjects like the image and status of lawyers, people's view of lawyers and the development of the bar in the context of public opinion. On the one hand, affected by dominant ideology that the trend to break old traditions and to learn western political and legal institution, lawyers at that time took protection of human rights as a propaganda symbol of themselves. Under the circumstances that the whole country was weak and judicial sovereignty had been violated, lawyers and bar association actively involved in judicial reform and recovery of judicial sovereignty, having contributed to law rule. Through newspaper, lawyers' activities were conveyed to general public and positively affected general ideology. On the other hand, because the rule of lawyers were not perfect at the beginning and many lawyers were not professional enough but earned a large profit, they left a bad impression to general people. Furthermore, influenced by Chinese traditional legal culture, many people thought that lawyers were just like songshi who confused right and wrong and worked exclusively for profit, so they did not trust lawyers. Additionally, there were some incorrect opinion about lawyer's function. Through news discourse, this paper finds out that under the multiattitude to lawyers, Chinese local lawyers developed gradually and bring out a huge social impact.
