영문 초록

This research is to study whether there is the legitimacy in proceeding Korean government, which has shifted itself from Korea Empire to KPG(Korea Provisional Government), and again to ROK(Republic of Korea). And it will also suggest a sound justifiable logic which longs for a unification era. Legitimacy arguement about KPG and ROK has been repeating itself both in North and South Korea after division. South Korea puts an exclusive legitimacy in KPG, denying Kim Il-sung of North Korea, while North Korea puts an exclusive legitimacy to Kim Il-sung's anti-Japanese action and valued KPG negatively, which is said to be the foundation of South Korea. The first topic is whether KPG succeeded Korea Empire. Goverment -General of Korea can't have the legitimacy after the fall of Korea Empire. Those who had acted for the liberation has legitimacy in this term. KPG, which has been founded 9 years after the fall of Korea Empire, has its legitimacy because it is the assembly of liberators and it is a democratic republic that realized 3‧1 Spirit. KPG seems to have its legitimacy for succession of Korea Empire and liberation force in the dimension of existencequality. However, KPG didn't have enough effect for its name value. It has done all what it had to do, right after foundation and before coming back to Korea, but hadn't been enough for long period between those. Therefore, the legitimacy in Korean history of this term was for all the liberators who had participated in anti-Japanese action. However, KPG deserves the legitimacy for lasting whole 27 years and continued its liberation action in world history. The next discussion is about whether ROK has truly done the succession of KPG. USA and USSR has divided and ruled Korean peninsula after liberation. ROK, which was founded in the southern part has clarified the succession of KPG in the front part of its constitution. However, that wasn't a perfect succession. ROK was more exclusive and setback than KPG. Therefore, it can't be told clearly that ROK has done the succession of the legitimacy of KPG. It's true that ROK has accepted the major goal of KPG, but reduced idealistic acception. The succession wasn't perfect. South and North Korea has been insisting their legitimacies exclusively. Attacking the other's logic has been done repeatedly in both side. But the definition of legitimacy is always different from term to term. In the liberation action term, the goal is liberation and the national conscience is the standard to judge the legitimacy. Therefore, if this kind of action has been carried on, they can own their legitimacy regardless of ideal. The standard of legitimacy in liberation action term was ‘nationalistic conscience’. KPG deserves to be judged major, for it has inherited the resistance action after the fall of Korea Empire, especially has reached the goal of founding modern nationalism country, which can be addressed 3‧1 spirit. Nevertheless, it wasn't a perfect monopoly. Because there were various powers which has been working on the same goal. Therefore, it would be better to say that KPG and other liberation actors has shared the legitimacy.Understanding the legitimacy of the term of division should be done by the wise person who can see through all the past, present and future, not staying in competitive and exclusive dimension, but foreseeing the unification era. The next standard of judging legitimacy would be the will for unification and human rights. That would put high possibility of securing nation's legitimacy and political power's rightness.
