국문 초록

지난 20년 동안 많은 다국적 범죄 조직들이 출현하였으며 오늘날에는 초국가적 수준의 다양한 범죄 조직들이 활동하고 있다. 이와 같은 안보 위협에 대하여, 국제 사회는 새로운 위협의 심각성을 인식하고 있으며, 지속적으로 대응책을 요구하고 시행하고 있다. 많은 국가들(nation-states)과 국가의 연합(coalitions of nation-states)들은 다양한 방식의 여러 범죄 조직들에 대항하고 있다. 그럼에도 불구하고, 오히려 국제 범죄조직으로부터 받는 현재의 위협은 지속되고 더욱 악화될 가능성이 높다. 국제 범죄조직에 대한 대응 실패의 원인 중의 하나는 위협의 특성에 대한 이해의 부재와 다양한 대응책을 제시하기 위한 체계적 개념 틀에 대한 이해의 부재로부터 기인한다. 최근까지도 여러 다른 범죄조직들을 구별하는 개념적 정의는 아직 개발되지 못했다. 이러한 정의의 부재로 인해, 정부 조직이나 기관들에 할당 된 다양한 대응책들은 종종 단편적이거나 모순되거나 혹은 잘못되곤 한다. 국제 조직범죄는 이러한 상황의 이점을 취하는 것으로 보이며 더욱 성장해 나갈 것으로 보인다. 이 논문은 국제 조직범죄의 현존하는 위협을 전반적으로 이해하기 위한 작동 가능한 개념적 틀을 개발하는 필요성을 기초로 작성되었다. 이 논문은 이러한 위협의 특성과 이에 대한 효과적인 대응책의 개발을 위해 필요한 개념적 모델을 제시한다. 또한 일르 바탕으로 정책적인 면에서의 대응 방안에 대한 아이디어를 제안하고자 한다.

영문 초록

Many multinational criminal organizations have emerged in the last two decades and now engage in various world-scale criminal operations. Responding to these security challenges, the world community has so far recognized the seriousness of this new threat and constantly calls for and exercises countermeasures to these threats. Many nation-states and coalitions of nation-states fight against different criminal organizations in various ways. Despite all these recognitions and countermeasure exercises, the actual criminal elements may not likely go away any time soon. Rather, the current threat from international organized crime is more likely to be sustained and possibly get worse. One of the reasons for this failure may be due to the spontaneity, arbitrariness, and ineffectiveness of state countermeasures, which seem to be derived from the lack of understanding of the nature of this threat and the systematic conceptual framework to guide various countermeasures. This paper is in response to the necessity of developing a workable conceptual framework to holistically understand the current threat of international organized crime. This conceptual framework is also expected to provide guidance for countermeasures to various types of international organized crime which has been recognized as a significant threat to nation-state systems and world order by many well-known scholars and experts. This paper calls for a holistic, conceptual approach in order to understand the nature of that threat and effectively develop countermeasures in response. Also, it proposes the idea of policy implication.
