국문 초록

우리사회에 이상성욕(異常性慾) 또는 변태성욕(變態性慾)에 의한 범죄가 빈번하게 발생하고 있다. 이상성욕에 의한 범죄 중 ‘소아성기호증’에 기인한 경우 사회적 폐해가 심각하다는 점에서 관련 연구들이 활발히 진행되고 있다. 특히 개정 「치료감호법」이 소아성기호증 및 성적가학증에 관한 치료의 근거를 마련함으로써 이상성욕 범죄자의 치료 공백을 해소한 것은 매우 바람직한 조치로 평가된다. 이상성욕의 세부유형인 노출증.물품음란증.마찰도착증.소아성기호증.관음증.성적가학증.성적피학증 등은 겉으로 잘 드러나지 않고, 환자들 또한 자신의 병적 증상을 밝히려 하지 않는다는 점에서 조기 발견이 어렵다. 또한 유병인의 성장기에 걸쳐 인격 깊숙이 고착화 되어 있어 치료가 어렵고, 재발 또는 재범 비율이 매우 높은 것을 특징으로 들 수 있다. 이러한 증상들은 단독으로 유발되기도 하지만 둘 또는 그 이상의 유형들이 함께 나타나기도 하고, ‘반사회적 성격장애’와 동시에 나타나기도 하며 성폭행.살인 등과 같은 보다 심각한 범죄로 발전되기도 한다. 이러한 점에서 현대사회의 특징적 현상이라 할 수 있는 이상성욕 관련 범죄에 대해 심리학․범죄학 등 관련 학문분야들이 연구를 보다 강화해야 할 필요가 있으며, 모든 형사사법기관들이 이러한 범죄자들의 특징적인 증상을 초범단계에서부터 판별해 냄으로써 조기 발견과 치료를 가능하도록 하고, 이를 통해 재범방지 및 지역사회의 안전 확보에 기여할 수 있도록 해야 할 것이다.

영문 초록

We are currently witnessing a surge of crimes related to sexual perversion, and sexual crimes that are caused by pedophilia cause severe social damage, calling for various research. It is worth noting that the recently revised Medical Treatment and Custody Act has resolved the gap in sexual criminals’ treatment by providing the base of the treatment of pedophilia and sexual sadism, and thus, is considered to be very promising. Detailed types of sexual perversion, such as exhibitionism, fetishism, frotteurism, pedophilia, voyeurism, sexual sadism, and sexual masochism, are difficult to diagnose and even patients of these symptoms do not often want to show their symptoms, making it difficult for these symptoms to be detected in their early stage. Furthermore, these disorders are deeply rooted in the patients’ character in the period of the patients’ growth, making the treatment difficult, and even if they are treated, there is a high probability of recurrence. Some patients show only one of these symptoms while others may exhibit two or more symptoms together. Other patients also show antisocial personality disorder along with these symptoms, which, in some worse cases, can develop into felony crimes like sexual violence or murder. Therefore, it is urgent that psychology, criminology and any other studies related to sexual perversion-related crimes must stress more on these symptoms, which are considered to be a peculiar phenomenon in modern society. Also all criminal and civil law organizations must strive to discern such characteristic symptoms from criminals in their early stage of criminal history so as to contribute to the reduction of second and repeated offenses and the safety of local society through the early discovery and treatment of these symptoms.
