대통령기록관리제도 시행의 의의와 과제

국문 초록

이 연구는 2007년 4월 27일 「대통령기록물 관리에 관한 법률」(이하「대통령기록법」으로 약칭함)이 제정되고, 2008년 4월에 대통령기록관이 개관하면서, 대통령기록관리제도가 시행되게 된 과정과 그 의의 및 과제를 살펴본 글이다. 2007년 4월에 「대통령기록법」이 제정되고, 이 법률에 의거하여 11월 30일 대통령기록관 직제를 신설하고, 2008년 4월에 대통령기록관을 개관하게 되었다. 「대통령기록법」이 시행됨으로써 대한민국 역사에서 대통령기록물을 관리하는 법적인 토대가 처음으로 마련되었으며, 대통령기록관리의 체계가 자리잡기 시작하였다. 「대통령기록법」의 제정과 대통령기록관의 설립은 대통령기록관리의 중요성을 명문화하고 대통령기록관리의 제도화를 시작하였다는 점에 큰 의의가 있다. 1948년 대한민국 정부 수립 이후 1998년 김영삼 정부 때까지 50년 동안 정부기록보존소에 이관한 대통령기록물은 총 13만여건이었으며, 1999년「공공기관의 기록물관리에 관한 법률」을 제정한 김대중 정부에서는 20만건의 대통령기록물을 이관하였다. 반면에 2007년에 「대통령기록법」을 제정한 노무현정부는 280 여만건의 대통령기록물과 530 여만건의 웹기록을 이관하였다.대한민국사에서 대통령기록물 이관의 신기원을 연 것이다.2007년에 「대통령기록법」이 제정되고, 그 다음 해에 대통령기록관을 개관하면서 대통령기록관리제도를 시행하게 되었지만, 1년 동안 많은 시행착오를 겪게 되었다. 대통령기록관리제도의 첫 발을 디뎠을 뿐이지, 그 제도를 정착시키기 위해서는 많은 노력이 기울여져야 할 것이다. 대통령기록관리제도를 시행하면서 나타난 주요 쟁점은 대통령지정기록물보호제도 문제,전직 대통령의 대통령기록물 열람권 문제, 대통령기록관의 독립성과 전문성의 문제 등이다. 이를 바탕으로 대통령기록관리제도를 정착시키기 위해서는 다음의 과제들이 완수되도록 노력해야 한다. 먼저 대통령기록관의 독립성과 전문성을 강화해가야 한다. 아울러 대통령기록관리위원회를 시급히 구성하여 대통령기록관의 운영을 컨설팅해야 한다. 기록관리전문인력의 배치와 전문가 양성에 노력을 기울여야 한다. 또한 대통령기록관은 대통령기록물을 제대로 이관받거나 수집해야 하며, 관리하고 있는 기록물을 국민 및 연구자들이 편리하게 이용할 수 있도록 서비스해야 할 것이다.

영문 초록

On April 27th, 2007 there were enacted laws about 「Presidential Records Management Act」, and in April, 2008 presidential archives was opened. As these incidents happened, this paper is to see the process of how it established and to look into significance and task of 「Presidential Records Management」. As 「Presidential Records Management Act」 was enacted in April 2007, Government made the organization of an office in Presidential Archives. In April 2008, Government opened Presidential Archives. As 「Presidential Records Management Act」 took effect, there was the first legal ground to manage presidential archives in Korean history. Also, presidential Archives management system was settled from that time. The enactment of Presidential Records Management Act」 and establishment of presidential archives give big significance in two points, which are stipulation of the importance in presidential records management and systematization of presidential archives management. From 1948 (Formation of Korean government) to 1998 (Government of Young-Sam Kim), presidential records had been transferred about 130,000 in Government Archives and Records Service(政府記錄保存所). Also, government of Dae-Jung Kim, which established 「Records Management of public instituition Act(공공기 관의 기록물관리에 관한 법률)」 transferred 200,000 presidential archive. On the other hand, government of Moo-Hyun Roh, which enacted 「Presidential Records Management Law」, transferred about 2,800,000 presidential rchives and 5,300,000 web records. It means a new epoch in transferal of presidential records in Korea history. 「Presidential Records Management Act」was enacted in 2007,and Presidential Archives was opened in 2008. We operated the Presidential Records Management System, butwe suffered the trial and error for one year. Nowadays we only made the first step in Presidential Records Management System, we must exert all possible efforts to settle down it. In operating of Presidential Records Management System, the issue in dispute is the protection of Presidential Records, the former President's Access about Presidential Records, Independence and speciality of Presidential Archives. we must accomplishment the follow task. First, we must strengthen the Independence and speciality of Presidential Archives. We must consitute Presidential Records Committee and consult the Presidential Archives' administration. We must station the Archivist and educate them in Presidential Archives. After the Presidential Records must be transferred and be collected in Presidential Archives, they must be opened and serviced to the researcher and people.
