대안학교의 제도화 과정과 법제화 방향에 관한 논의

국문 초록

본 연구는 법제화를 앞둔 한국 대안학교의 제도적 정착과정 반성과 법제화 방향 모색에 목적을 두었다. 비인가 형태로 운영되던 한국의 대안교육은 1998년 특성화학교 법과 자율학교 법의 시행으로 다소의 자율성을 보장받으면서 정규 교육으로 편입이 가능하게 되었다. 두 법안의 통과로 인해 대두된 교육과정 편성과 운영의 어려움, 교사발령으로 인한 교사분리, 대안초등학교 문제 등의 해결을 위해 2005년 대안학교 법이 통과되고, 2006년 3월 시행을 목표로 시행령을 준비하게 되었다. 그러나 법제화 팀이 마련한 ‘대안학교 설립․운영 규정(안)’의 시행 시기는 여전히 미지수로 보인다. 법제화 필요성과 학력인정 여부, 시설시준․교사자격․교육과정 편성과 운영 등의 인가기준, 재정지원 범위 등과 같은 핵심 문제 해결이 쉽지 않기 때문이다. 이해관계에 따라 ‘규정(안)’의 일부 수정이 불가피할 것으로 보이지만, 법안 마련의 본질적 취지가 대안교육 지원에 있다는 점을 고려한다면, 대안학교 설립인가 규정의 엄격한 적용, 교사자격 관련 조항의 탄력적 운영, 교육과정 조항의 실질적 이행을 위한 제도적 보완책 등이 법안에 반드시 반영되어야 할 것이다.

영문 초록

In this paper, I discussed on the institutionalization and legal direction of the alternative schools in Korea. The alternative schools in Korea are increased because of the unsatisfactory results of public education and the provisions for alternative schools in 'elementary, secondary educational law', such as specialized school and regulation-free school. And the Presidental Decree for alternative schools is preparing presently. But there is in a controversy with the proposals by scholars, centering around the criteria for permitting to found alternative schools, the extent of the financial support for alternative schools and the necessity of legalization of the alternative schools. The suggestions to legalize alternative schools are as follows. First, the provisions related with founding alternative schools are to be applied strictly to prevent founding a pseudo-alternative school for person profits. Second, the provisions related with qualifying for teaching are to be applied flexibly to recruit competent teachers suitable for the object of an alternative school. Third, the provisions related with the curriculum of an alternative school are to be complemented institutionally to qualify management of curriculum in an alternative school.
