성매매사범의 동기 억제를 위한 정책변화에 관한 연구

국문 초록

  유엔은 모든 체약국과 체약국 국민이 공통적으로 달성해야 할 인권의 기준인 세계인권선언을 채택하였다. 특별히 제1조는 "모든 사람은 태어날 때부터 자유롭고 동등한 존엄성과 권리를 가지고 있으며, 천부적으로 이성과 양심을 가지고 있으며 서로 형제애의 정신으로써 행동하여야 한다."고 규정하였다.
  이어서 유엔은 여성의 인권을 위한 국제적 약속이라고 할 수 있는 여성차별철폐협약을 1979년에 채택함으로써 여성에 대한 모든 차별적 행위를 금지하였다. 이 협약 제6조는 "당사국은 여성에 대한 모든 형태의 인신매매 및 성매매에 의한 착취를 금지하기 위하여 입법을 포함한 모든 적절한 조치를 취하여야 한다."고 규정함으로써 성매매행위를 범죄적 행위로 규정함으로써 성매매 사범의 범죄동기를 억제하고 있다.
  한국은 유엔의 이러한 성매매금지적 입장을 지지하면서 2004년도에 성매매처벌법과 성매매피해여성지원법을 제정하였다. 성매매피해 여성을 위한 상담시설, 보호시설의 운영 및 의료적？법률적 서비스를 보조하고 있으며, 신용보증 및 회복을 위한 지원 및 상담, 그리고 그룹 홈, 쉼터 등을 지원하고 있다.
  또한 정부는 2005년 8월 이후 검거된 성구매남성 중 초범을 대상으로 이들을 처벌하는 대신 수강명령인 존스쿨 교육을 실시하고 있으며, 수사과정 중 성매매피해여성의 인권보호를 위하여 전국에 성매매수사 전담경찰관 534명을 배치하였다. 한편 성매매를 예방하기 위한 계도 및 국가적 차원의 연구조사, 그리고 관련법규를 설명하는 안내서를 발간, 배포하는 등의 홍보활동을 하고 있다.
  이러한 법률제정과 정책 등은 유엔의 성매매금지적 정책을 기조로 하고 있지만, 현실적으로 여전히 다양한 형태의 성매매가 진행되고 있어 해결해야 할 정책적 과제라 할 것이다.

영문 초록

  UN proclaims Universal Declaration of Human Rights as a common standard of achievement for all peoples and all nations. Specially Article 1 : All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.
  And The Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), adopted on 1979 by the UN General Assembly, is often described as an international bill of rights for women. CEDAW States Parties shall take all appropriate measures, including legislation, to suppress all forms of traffic in women and exploitation of prostitution of women(Article 6). This code defines criminal behavior against prostitution and that is purposed of protection human right of women.
  From UN point of view, Korea government legislated two acts at 2004, on the punishment of procuring prostitution and prevention of prostitution and protection of victims. Korea government attempts to prohibit all acts of prostitution, as well as the activities that promote it, such as keeping a brothel. Support System for Victims of Forced Prostitution are counseling centers counseling, medical support, collaborated with the credit counseling and recovery service, group home system, shelters.
  Moreover, the government has been running the John School program for educating, rather than prosecuting first-time male offenders of prostitution since August 2005. The National Police Agency has placed 534 police investigator. This policy protect human rights of victims of forced prostitution in investigation.
  Aims for prostitution prevention, the government conducted campaign activities, national surveys, guidebooks and leaflets on the legislations on prostitution prevention.
