민간협력적 관점에서 국가테러대응 체계 연구

국문 초록

테러와 같은 국가의 위협 대응 방식은 그 시대를 반영한다고 하는데, 지금은 윌리엄 린드(William Lind)가 정의한 4세대 위협의 비정규성과 인공지능 등의 과학적 진보된 기술이 결합한 특징을 갖고 있고, 이러한 위협은 민간협력을 통한 방안을 모색할 필요성이 있다. 이 연구에서는 미국 9/11 테러 사례는 해외정보와 국내 방첩의 통합은 예방적 측면에서 중요성이 있지만, 미국 국가안보국(NSA)의 불특정 개인정보의 침해 사례와 이를 기반으로 테러를 예방하였다는 사실의 존재와 이러한 사회적 이슈를 분석하였다. 이러한 관점에서 중앙정보국(CIA)과 연방수사국(FBI)의 설립과정을 근거로 대테러 기관과 국내정치적 관계를 조명하며, 지난 정부에서 시작된 고위공직자범죄수사처 신설과 검･경 수사권 조정 그리고 검찰의 수사권 축소와 국가정보원의 대공수사권 경찰청 국가수사본부로 이관 이후 마약, 보이스 피싱, 도박 사이트 증가 뿐만 아니라 2023년 신림역과 분당 서현에서 사회적 테러 및 아시아나 항공기에서 출입문 강제 개방과 같은 극단적 행위 증가 현황을 근거로 테러방지법의 한계점을 제시하였다. 따라서 국가테러대응 체계의 민간협력 방안으로 국내적으로는 CPTED와 자율방범대를 통한 민간협력 확대와 해외에서의 탐정 활동 근거 도입 방안을 제시하였으며, 민간협력체계 구축의 타당성을 수익자부담이론, 공동화이론, 경제환원론적 이론을 인용하여 뒷받침하였다.

영문 초록

The country's response to threats such as terrorism reflects the times, but now it is characterized by a combination of the irregularity of the 4th generation threat defined by William Lind and scientifically advanced technologies such as artificial intelligence, and these threats are There is a need to explore ways through private cooperation. In this study, in the case of the 9/11 terrorist attacks in the United States, the integration of foreign intelligence Overseas part and domestic counterespionage is important from a preventive perspective. However, based on the case of the U.S. NSA's violation of unspecified personal information and this, The fact that terrorism was prevented exists and this social issue was explained. From this perspective, the relationship between counterterrorism agencies and domestic politics was observed based on the establishment process of the CIA and the FBI. The policy change, which began with the establishment of the High-ranking Public Officials Crime Investigation Office, led to adjustments in the investigative powers of the prosecution and police. As a result, the prosecution's investigative authority was reduced and the anti-communist investigative authority of the National Intelligence Service (NIS) was transferred to the National Investigation Headquarters of the National Police Agency. In addition to the subsequent increase in drug, voice phishing, and gambling sites, social terrorism occurred by some citizens at Sillim Station in the 2023 subway and Seohyun in Bundang, also there is also current data showing an increase in extreme acts such as forcibly opening doors on Asiana aircraft. And the limitations of the Anti-Terrorism Act for the Protection of the People and Public Safety were presented. Therefore, as a private cooperation plan for the national terrorism response system, a plan was proposed to expand private cooperation domestically through CPTED and Self-Defense Forces and to introduce grounds for private investigation activities overseas. The plan was to establish a private cooperation system. The validity was supported by citing the beneficiary burden theory, vacuum theory, and theory of economic reduction.
