국문 초록

본 연구는 사행산업의 정책 담보를 확립하여 국민이 올바른 사행산업을 이해하고 몰입폐해를 예방 및 교육, 재활을 지원 할 수 있는 ‘사행산업몰입폐해 예방 및 지원법 시안에 관한 연구이다. 사행산업 폐해로 인한 육체적, 정신적, 금전적 등의 피해를 가진 몰입자 및 가족을 사회의 복귀가 가능할 수 있도록 돕고 범국민 교육 및 지원의 사행산업폐해 예방 및 지원에 도움을 줄 수 있는 법적, 정책적 환경을 마련하기 위함에 그 목적이 있다. 연구는 사행산업몰입폐해 예방 및 지원 시안을 특별법으로 제정하여 사행산업 정책의 일관성을 담보로 하기 위한 것이다. 첫째, 정책의 일관성 담보로 위한 법적 근거 마련이 요구된다. 둘째, 사행산업부작용 폐해최소화를 위한 예방 및 지원체계의 구축의 특별법이 요구된다. 현재 사행산업통합감독위원회법은 사행산업통합감독위원회 하에 도박중독예방치유센터를 설치할 것을 규정하고 있다. 그러나 동 센터는 현재 도박중독을 예방하고 치유할 수 있는 실질적인 기관이라기보다 형식적인 기구에 불과한 것이다. 셋째, 사행산업정책 목적에 부합하는 정부정책과 국민의 함의의 문화컨텐츠개발(게임산업) 프로세스의 구축이 요구된다. 이에 따라 사행산업은 중독과 도박이라는 부정적 편견도 팽배한 실정이다. 따라서 사행산업을 ‘금전의 획득수단’이 아닌 ‘즐기기 문화’로 인식하게 하는 것은 향후의 중요한 정책과제가 된다. 또한 합리적이고 체계적인 사행산업 규제정책 수립과 집행으로 국가의 게임산업시장을 위해서는 국민들의 지속적인 관심과 정치적 지지가 필요하기에 특별법 시안을 제안한다.
