학교체육에서의 양성평등 실현을 위한 법정책적 제안

국문 초록

본 연구는 한국 학교체육에서 성차별적인 관행이 존재한다는 가정 하에 이러한 관행을 개선하고양성평등을 실현하기 위한 법정책적 대안을 제시하고자 하였다. 이를 위하여 학교체육에서의 ‘양성평등’ 모범 사례로 알려져 있는 미국의 Title IX을 응용하였다. 이러한 연구목적을 달성하기 위하여우선 미국의 Title IX 관련 법령을 면밀히 분석하였고, 학교체육에서 양성평등 실현 가능한 한국 법령을 고찰한 후 마지막으로 미국 Title IX에서 발견한 시사점을 토대로 한국의 법정책적 대안을 제시하였다. 결론적으로 이러한 Title IX을 한국에 응용한다면, 본 연구에서는 신법을 제정하기 보다는 기존「학교체육진흥법」을 개정하는 방안을 제안하였다. 개정안에는 다음과 같은 조항들이 포함될 수있을 것이다: 성차별 금지 및 예외, 재정지원 거절 및 종료, 학교체육진흥원, 구제 및 적극적 조치,양성평등 전담직원 지명과 고충처리절차, 시설의 유사성, 재정지원, 대학운동부의 3가지 검사, 그리고 대학 운동프로그램 보고 및 공개. 그러나 과연 정부 재정지원 삭감이 학교들에게 법을 준수하도록 강제할 수 있는가? 여학생들은 양성평등을 누릴 준비가 되어 있는가? 선수저변이 약한 한국 운동부에게 양성평등 실현이 가능한가? 그리고 법률개정만이 해답인가? 하는 한계점은 남아 있다. 그럼에도 불구하고 한국형 Title IX에 대한 시대적 요청에 따라, 해당 법령을 성공적으로 실현하기 위해서는 법 개정과 더불어 현실에 직면해 있는 한계들을 극복하는 노력들이 병행되어야 할 것이다.

영문 초록

This study is to propose legal and institutional suggestions to improve the current practiceand realize gender equity on the assumption that there are discriminatory practices in schoolsports in Korea. To achieve these goals, this study analyzes relevant laws of Title IX which isconsidered an exemplary case of advancement of gender equity in school sports. Then, analysisof relevant Korean laws about gender equity in school sports follows. In conclusion, it makessuggestions about how to reflect the implications of Title IX and formulate effective policies. To apply Title IX in Korea, this study suggests a proposal to amend the current 「SchoolSports Promotion Act」instead of enacting a new Act. The provisions in the amendment canbe included: sex discrimination, refusal of financial assistance, roles of the School SportsDevelopment Institute, remedy and affirmative action, designation of responsible employee andadoption of grievance procedure, comparable facilities, financial assistance, three-prong-test, andEADA. However, there still are a few questions come to mind as mentioned above. Would itbe possible for a provision of reducing financial assistance from the government to enforceeducational institutions to abide by the Korean version of Title IX? Are Korean femalestudents ready to enjoy gender equity? Would promoting gender equity be effective for theKorean athletic clubs which have weak foundation for athletes? Would amendment be onlysolution? Regardless of such concerns, government should hold down both the amendment ofthe present Act and efforts to overcome constraints in order to successfully implement theKorean version of Title IX, thereby meeting the demands of the times.
