국문 초록

본 연구의 목적은 스포츠 정책에 대하여 법의 작동 기제가 어떠한지 논의하고, 스포츠에 대한 법정책의 도입과 그 발전 방향을 논의하는 데 있다. 본 연구의 목적을 달성하기 위하여 구성된 주요 논의구조는 다음과 같이 크게 세 단계로 설정하였다. 첫째, 스포츠 정책학의 구성개념 및 도입배경을 확인하였다. 둘째, 법정책의 이해 및 스포츠의 법정책 수용성을 확인하였다. 셋째, 스포츠 법정책의 발전방향 모색을 실시하였다. 이상의 논의를 통해 결론적 제언을 제시하였다. 첫째, 스포츠 정책은 스포츠에 관한 정책 또는 스포츠를 위한 정책으로 복지적 성격이 강하다. 스포츠 정책은 정치적 수단으로 이용된 배경이 있으나, 스포츠 자체에 대한 정책목표가 설정되어야 한다. 둘째, 법정책학은 ‘정책학적 법학(policy-oriented approach to legal study)’과 법 지향적 정책학(law-oriented approach to policy science)으로 성격을 정의할 수 있다. 스포츠의 법정책 수용은 최근 들어 입법기능에 의한 법 지향적 정책의 성격을 가지고 있다. 스포츠에 대한 법의 영향은 목적과 내용 모두에 영향을 미친다. 법에 의해 영향을 받은 스포츠 정책은 다시 그 발전목표에 따라 입법이 시행되는 상호 영향 관계를 맺고 있다. 셋째, 법정책은 사회의 이상적 목표로 설정된 정책목표를 결정하는 동시에, 역동적인 집행과정 및 집행결과에 대한 평가까지 포함되어야 한다. 따라서 스포츠 법정책은 입법 중심적인 차원과 함께 행정은 물론 사법 기능의 작동을 시도하여야 한다. 논의과정의 결론을 요약하면, 스포츠 정책을 수립하기 위하여 스포츠법을 개정 및 보완하는 작업이 요구되며, 나아가 타 법률에 근거하여 정책을 수립하는 조직적이고 체계적인 정책수립 노력이 확장될 필요가 있다. 즉, 스포츠 정책에 대한 체계적인 법정책적 접근 노력이 요구된다.

영문 초록

The purpose of this study is to discuss how the mechanism of action of the law works for sports policy, and to explore the application of the law policy to sports and the direction of its development. In order to achieve the purpose of this study, the structure of the discussion process was set in three issues as follows. First, the concept of construction of sports policy science and the background of its introduction were reviewed. Second, the concept of legal-policy was understood, and the acceptance of legal-policy in sports was discussed. Third, the direction of development of sports legal-policy was sought. The main contents of the each discussion stages are as follows. First, sports policy has strong welfare characteristics as a policy about sports or a policy for sports. Sports policy has a background used as a political means, but since now, the policy should be established for the purpose of sports itself. Second, legal policy science can be defined as policy-oriented approach to legal study and law-oriented approach to policy science. The acceptance of sports legal policy has recently been characterized by a law-oriented policy based on the legislative function. Sports policies influenced by the law have a mutual influence in which legislation is again implemented according to the development goal. Third, legal policy determines policy goals set as the ideal goals of society, and the dynamic execution process and evaluation of execution results should be included. The concluding suggestions derived through the above discussion are as follows. Sports legal policy should attempt to operate the legislative and administrative functions as well as the judicial functions at the same time. In order to establish a sports policy, the work of revising and supplementing the sports law is required. Furthermore, there is a need to expand systematic and systematic policy-making efforts to establish policies based on other laws. In other words, systematic legal policy approach to sports policy is required.
