스포츠선수의 인권보장을 위한 특별사법경찰관제 도입방안 논의

국문 초록

최근 일부 스포츠종목 선수가 자살한 사건은 사회적으로 큰 충격을 주었다. 해당 선수는 숨지기 전 대한체육회와 경찰에 도움을 요청하였지만 도움을 받지 못한 것이다. 이 사건은 2019년 스포츠인권특별조사단이 발족하여 체육 전 분야의 성폭력 및 폭력피해 여부에 대한 전수조사를 실시한 이후에 발생한 사건이라서 그 반향은 더욱 컸다. 주목할 점은 피해선수가 대한체육회와 경찰에 도움을 요청하였음에도 아무런 도움을 받지 못했다는 점이다. 여기서 두 가지의 문제를 유추할 수 있다. 먼저 대한체육회에서 자체적으로 이루어지고 있는 선수보호시스템이 제 기능을 하지 못하고 있다는 것이다. 둘째 경찰이 스포츠계의 특성에 맞는 수사절차를 가동하지 못했다는 점이다. 당시 대한체육회는 스포츠인권센터에서 스포츠인권 신고 및 상담실을 운영 중이었지만 해당 선수에 대한 조사는 진행되지 않았다. 해당 선수가 소속했던 자치단체도 접수된 사건을 조사하는 과정에서 가해자에 대한 조사를 생략한 채 허위보고서를 작성한 것으로 드러났다. 우리나라는 그동안 스포츠 분야에서 엘리트정책을 유지하면서 스포츠선수의 인권문제에 관심을 기울이지 않았다. 그로 인해 메달을 따기 위해서라면 스포츠선수 개인의 인권은 어느 정도는 희생될 수밖에 없다는 통념이 만연되었다. 지금까지 이어져온 스포츠선수의 성폭력 및 폭력 피해는 이러한 인식의 결과라 할 수 있다. 스포츠계는 지금까지 성과주의에 매몰되어 왜곡된 통념이 확산되어 선수에 대한 인권침해 피해를 인지해도 이를 은폐해 왔다. 이러한 흐름이 오늘의 문제를 야기한 것이지만 지금까지 이어져온 왜곡된 인식은 쉽게 변하기 어렵다. 이제 스포츠선수의 인권을 효과적으로 보장하기 위해 그동안 만연되었던 관행과 권위 등에 의해 영향 받지 않고 스포츠계에 대한 이해와 인권감수성이 높은 전문가에 의한 공정한 법집행이 필요한 상황이다. 이의 실현을 위해 특별사법경찰관제도의 도입이 검토되어야 한다.

영문 초록

The recent suicide incident by some athletes gave a big social impact. The athlete asked for help from the Korea Sports Association and the police before he died, but he did not receive the help. This incident occurred after the launch of the Sports Human Rights Special Investigation Group in 2019 and conducted a thorough investigation into whether sexual violence and violence in all areas of sports were damaged, so the reaction was even greater. It should be noted that even though the victim requested assistance from the Korean Sports Association and the police, they did not receive any help. Two problems can be inferred here. First of all, the athlete protection system, which is implemented by the Korean Sports Association, is not functioning properly. Second, the police could not operate an investigation procedure that fits the characteristics of the sports world. At that time, the Korea Sports Association was operating a sports human rights report and consultation room at the Sports Human Rights Center, but no investigation was conducted on the athlete. The Gyeongju City Hall where the athlete belonged also closed the case without investigating the perpetrator. Korea has maintained its elite policy in the sports field and has not paid attention to the human rights issue of sports players. As a result, it has become widespread that the human rights of individual athletes must be sacrificed to some extent in order to win medals. The reason why sports players have been unable to escape from sexual violence and violence so far is due to wrong values. The sports world has so far been biased toward focusing only on results, ignoring and concealing human rights violations that occurred to players. This trend has created today s problems, but these misconceptions are difficult to change. Now, in order to effectively guarantee the human rights of athletes, it should not be affected by the prevalent wrong practices and authorities. And it is time for fair law enforcement by experts who have a good understanding of the characteristics of the sports world and are highly sensitive to human rights. In order to realize this, the introduction of a special judicial police officer system should be considered.
