법과대학 민법교육방법에 관한 시론

국문 초록

홍익대학교 법과대학은 학생들의 대학원진학, 취업 등을 위해 내부적으로 진로트랙을 두고 있으며, 트랙별로 관련과목 담당교수가 지도교수로 배정되어 학생의 진로 및 수강과목 등을 지도하고 있다. 가령 로스쿨 트랙의 경우, 로스쿨 진학을 희망하는 학생에 대해서는 헌법, 민법, 형법을 철저히 수강하고, 그 법리를 바탕으로 민사소송법, 형사소송법, 행정법, 상법의 법리를 체계적으로 이해하도록 지도하고 있다. 또한 헌법⋅민법⋅형법의 경우는 동일 강좌를 여러 개 개설하여 트랙별 지도교수가 학생들의 진로에 맞는 강의를 진행하고 있다. 특히 민법의 체계적인 이해를 바탕으로 문제해결능력을 배양하기 위해, 기초강좌의 경우에는 교재의 기본내용만을 단편적으로 전달하지 않고 민법 전체를 유기적으로 설명하고 있으며, 필요한 부분에서는 다른 법학의 내용을 간략히 다루고 있다. 심화강좌인 민법특강과 민사집행법의 경우에는 기초강좌를 통해 배운 내용을 바탕으로 하여 민법과 절차법을 융합한 방식으로 강의를 진행하고 있다. 그밖에 학생들이 법학전문대학원에 진학하여 시험문제에 적응력을 높이고 경쟁력을 갖추기 위해, 로스쿨 트랙 민법강좌의 시험문제는 변호사시험 사례문제와 같은 유형으로 출제하여 평가하고 있다. 하지만 대학여건에 따라 교육내용이나 방법이 다를 수밖에 없다. 따라서 법과대학의 민법교육방법을 일률적으로 제시한다는 것은 처음부터 불가능한 일로 여겨진다. 이 글에서는 홍익대학교 법과대학 로스쿨 트랙을 중심으로 교과과정을 살펴보았지만, 이를 통해 대학의 특성에 맞는 바람직한 교육방법이 도출되는 계기가 되었으면 한다.

영문 초록

There has been criticism that the existing education by the colleges of law centered on a small number of students preparing for the bar examination, overly focused on concepts and theories, and failed to consider the connectivity with related subjects. Considering these problems, the College of Law of Hongik University internally provides a Career Tracks system that reflects students desired career paths, opens several courses for each subject of the constitution including civil law and criminal law so that the professors can provide customized lectures, and makes full use of case studies for theoretical education. Besides, in order to enhance students’ integrated thinking abilities, the college handles the contents of both civil law and other related laws for civil law courses on law school track, and provides Special Topics in Civil Law and Civil Execution Law lectures, which are in-depth lectures, in the way of covering civil law, civil procedure law and civil execution law simultaneously based on what students learned through basic courses. It is a great thing that many students who have completed the law school track in the college enter law school and make great achievements. Currently, the paradigm of university education is changing into a student- centered customized education. Thus, being good at delivering lectures only in the field of his or her major is not enough for a professor. Although it is necessary to conduct in-depth studies of the professional field for the development of discipline, it is important to have a wide range of knowledge enough to give lectures on legal theories that are related to his or her major for a better lecture.
