덕치와 법치

국문 초록

흔히 유가의 덕치와 법가의 법치는 서로 대립하는 것으로 생각되지만, 교육학적 관점에서 볼 때, 양자는 상호보완적인 관계를 가지는 것으로 이해될 수 있다. 정치이론으로서 덕치와 법치는 모두 도, 천리를 추구한다는 동일한 목적을 가진다. 다만 그 방법에 있어서 덕치는 법치에 비하여 보다 포괄적인 영역에 걸쳐있다. 흔히 덕치를 군주의 도덕적 모범에 의한 교화 정도로 오해하지만, 「논어」에 나타난 덕치는 박시제중을 위한 실제적 정치활동을 수행하되, 그 과정에서 반드시 예가 준수되어야 함을 강조한다. 반면에 「한비자」에 나타난 법치는 법세술의 세 가지 요소를 종합함으로써 행위지침으로서의 법이 가지는 한계를 보완해준다. 그럼으로써 법치는 덕치의 예가 가지는 두 가지 측면—이론적 탐구로서의 예와 행위지침의 준수로서의 예—중에서 행위지침의 준수를 통한 심성함양의 과정을 보다 세부적으로 밝혀준다. 행위자를 둘러싼 사회의 권위(세)와 주변 사람들의 관심(술)은 직관적 사고를 통하여 행위자의 심성이 함양되는 기제이다. 본 연구의 관점에서 볼 때, 유가의 정치이론은 직관적 사고를 통한 심성함양과 더불어 개념적 사고를 통한 심성함양을 포괄하는 반면에, 법가의 정치이론은 전자의 가능성만을 인정하면서 그 과정을 상세하게 구안한다는 특징을 가진다.

영문 초록

This paper investigates the concepts of ‘governing by virtue’(德治) in the Analects and ‘governing by law’(法治) in Hanfeitz, reinterpreting them from the perspective of educational theory. First, it should be noted that governing by virtue is often misunderstood as showing moral models by the king without involving any practical matters in politics. However, according to the Analects, governing by virtue means to practice li(禮) while actually managing all the political activities. This political process itself is educational process because li includes both knowledge and rules of behaviors through which men cultivate themselves. Second, governing by law in Hanfeitzu depends on not only law(法) but also shi(勢) and shul(術). These three elements contribute to the educational process through intuitive thoughts rather than conceptual thoughts, involving social authorities and concerns. The theory of governing by law compensate for the theory of governing by virtue, of which li has wide range of meaning including law, but lacks of any detailed explanation about the process cultivation of mind through intuitive thoughts. The theory of governing by law and the theory of governing by virtue can get along with each other as educational theories, even though the theory of governing by virtue provides much more comprehensive view concerning the whole process of education. Both of them reveal that genuine politics essentially has educational dimension.
