국문 초록

‘학교폭력 예방 및 대책에 관한 법률’은 학교폭력 문제에 대한 효과적 예방 및 대책을 위해 2004년에 제정되었다. 이후 이 법률은 2017년까지 총 19회의 법률 개정이 이루어졌다. 이 연구는 역사적 신제도주의 관점에서 학교폭력 예방 및 대책에 관한 법률의 변화과정 및 영향 요인을 분석하는데 목적이 있다. 구조, 제도, 행위자 수준에서 분석한 본 연구의 결과를 제시하면 다음과 같다. 첫째, 구조 수준에서 보면, 학교폭력 예방 및 대책에 관한 법률과 관련하여 경로의존성(path dependency)을 깨는 중대한 전환점(critical junctures)은 사회적으로 큰 반향을 일으켰던 학교폭력 사건들이었다. 둘째, 정부부처의 대처와 사회 인식의 변화를 중심으로 살펴본 제도 수준의 특징을 보면, 학교폭력의 개념과 범위가 확대되었으며, 정부 대책은 안전한 학교교육 환경 조성 및 사회적 인프라 구축에 역점을 두었다. 셋째, 행위자 수준에서 보면, 학교폭력 관련 법률의 제·개정에 관여한 공식적·비공식적 행위자들은 학교폭력문제가 그들의 권력과 이익에 큰 영향을 주지 않는다고 보고 의견제시 등과 같은 온건한 행동 방식을 주로 취하였다. 이와 같은 연구결과가 제시하는 시사점은 첫째, 학교폭력과 관련된 제도개선은 구조적 수준의 외적 충격에 의존할 것이 아니라, 원시안적 관점에서 미래의 학교폭력 변화를 예측하고 이에 대응하는 방식으로 이루어져야 한다. 둘째, 학교폭력 문제의 효과적 예방과 대책 수립을 위해 다양한 행위자들의 상호 협력체제를 구축해야 한다. 셋째, 학교폭력과 관련된 정책은 학생들의 눈높이에서 수립되어야만 근본적인 효과를 얻을 수 있다. 넷째, 학교폭력 사건의 예방과 근절을 위한 사회적 공감대 및 연대 의식의 강화가 필요하다.

영문 초록

‘The Act on the prevention of and countermeasures against violence in schools’was enacted in 2004. Since then, the law has been revised 19 times partially or wholly. This study aimed to investigate what has been changed and what factors would affect such changes since its establishment from the perspective of historical new institutionalism, particularly three aspects of structure, institution, and actors. The findings of the study were as follows; first, looking at the structural aspect, critical junctures in revisions of the school violence law were more related to school violent incidents that were socially shocked and resulted in breaking path dependency; second, as from the institutional aspect, the concept of school violence and its range were expanded in the revisions and governmental policies have focused on creating relevant school environment and building social infra system for safer school life; third, actors involved officially or unofficially in revising the school violence law utilized moderate ways such as media interviews to revise the law rather than radical demonstrations. From these findings, the study suggest that for better prevention of school violence law revisions and policy reforms of school violence should be made based on reliable predictions of school violence and much understanding of students in adolescence. In addition, social empathy and solidarity should be built and strengthened to prevent and root out violence in schools.
