장애관계법령 체계화 방안

국문 초록

본 연구목적은 ｢장애인기본법｣ 마련을 통해 장애관계법령을 체계화하고 국가가 장애라는 사회적 위험을 효과적으로 관리⋅대응할 수 있도록 법의 기본원칙과 방향, 정신을 담는데 있다. 연구결과 첫째, 기본법은 국가의 주요한 제도 및 정책의 방향성을 천명하고, 개별법의 제⋅개정 지침을 지시하는 법적 성격을 갖고 있어 장애관계법령 체계화에 기본법 체계를 수용하는 것이 적합하다. 둘째, 장애관계법령을 좁은 의미의 장애관계법령과 넓은 의미의 장애관계법령으로 구분하고, 장애관계법령의 현황 및 체계화를 기술하였다. 셋째, 기본법의 구성 체계 분석을 통해 ｢장애인기본법｣을 제6장 제47조 구성하였고, 헌법 아래 장애관계법령을 아우르는 상위법적 성격을 갖도록 하였다. 마지막으로 ｢장애인기본법｣ 제정에 따른 장애관계법령 정비 방안으로 ｢장애인복지법｣의 내용 중 기본법적 성격은 ｢장애인기본법｣으로 이동하거나 장애관련 개별법으로 재분류하고, 나머지 조항들은 ｢장애인자립지원법｣과 ｢장애인권익옹호법｣을 대체 입법으로 제정할 것을 제안하였다. 본 연구의 의의는 첫째, ｢장애인기본법｣의 제정을 통해 장애관계법령의 체계화와 장애관련개별법의 제⋅개정 방향과 기준을 제시할 수 있다. 둘째, ｢장애인기본법｣을 토대로 한 일원화체계를 통해 장애관계법령 간의 관계를 명료하게 정리하였다. 셋째, ｢장애인기본법｣을 통해 사회전반에 걸친 장애인에 대한 장벽 제거 및 비장애인과 동등한 권리주체자로서 장애인 당사자의 사회참여와 이를 통한 자립생활 구현에 도움이 될 것이다.

영문 초록

The purpose of this study systemize disability related laws through the Basic Act on the disabled and includes the basic principles, directions and spirit of the law so that the state can effectively manage the social risks of disability. The results of study first, It is appropriate to accommodate the Basic Law system in systematizing disability related laws because that the Basic Law announces the direction of the major institutions and policies of the state, has a legal nature that directs the revision guidelines of individual laws. Second, It divided into narrow and broad disability related laws, described status and systematization of disability-related laws. Third, By analyzing the constitution system of the Basic Law, the Basic Law for the Disabled was composed Article 47, Chapter 6, and to have a higher legal character covering the disability related laws and regulations under the Constitution. Last, as a measure to improve disability related law, the basic legal nature of the contents of the Welfare Act for the Disabled is transferred to the Basic Law for the Disabled or reclassify to disability related laws. The remaining provisions, it proposes to enact the ｢Act on Supporting the Independence for the Disabled｣ and the ｢Act on Advocating the Rights for the Disabled｣. The meaning of the study, first, through the enactment of the Basic Act for the Disabled, it can be presented of the systematization of disability related laws and the directions and criteria of individual disability related laws. Second, it clearly clarifies the relationship between disability related laws and regulations through a unification system based on the Basic Law for the Disabled. Third, the Basic Law for Disabled will help to eliminate the barriers to the disabled in society, and to participate in society and to realize independence living for the disabled as an equal entitlement to the non-disabled.
