독일의 아동⋅청소년복지법제와 시사점

국문 초록

아동청소년복지의 중요성에 비추어 현행 관련 법률은 아동과 청소년으로 구분되어 보육 및 양육과 성장이 일관된 체계에서 관리되지 못하고 있으며, 사회교육적 이념이 부재된 상황에서 아동청소년의 위기에 충분히 대응하지 못하고 있다. 이에 대해 독일의 아동청소년복지법은 그 중심을 보호에서 복지로, 다시 지원으로 전환하여 사회법전 제8권을 구성함으로써 아동청소년복지를 일반적인 사회보장체계 내에서 보장하고 있다. 기본적인 법적 근거는 사회법전 제8권 이외에 기본법과 사회법전 제1권의 관련 규정에서 찾을 수 있다. 아동청소년복지의 기본적인 법률관계는 아동, 부모, 국가의 3면 관계를 전제하고 있으며, 공적 담당기관으로서 청소년청의 역할과 권한이 강하게 보장되고 있다. 다른 급부와의 관계에 있어서도 아동청소년지원급여는 기본적으로는 우선 적용이 인정되지만 사안에 따라 후순위 적용되기도 한다. 아동청소년복지를 위한 재정은 주정부와 기초자치단체의 재원을 기초로 하며, 가정에서의 양육을 기본원칙으로 하여 보육과 양육에 대한 시설이용 및 교육에 대한 권리가 법적으로 인정된다. 물론장애가 있거나 외국인인 아동청소년에 대해서도 지원과 초기 성년자에 대한 지원을 보장하고있다. 기본적으로 아동청소년복지는 연령기준을 27세 미만의 청년으로까지 확대하여 청소년기를 거쳐 성년에 이른 경우에도 자활이 가능하도록 연장된 지원을 보장하고 있다. 민간복지기관에 대한 허가를 통한 엄격한 관리는 물론 사법정차상의 협력을 통해 아동청소년의 권리가 침해되지 않도록 보장하고 있으며, 청소년청에 의한 체계적인 지원이 이루어지도록 하고 있다. 이러한 독일 아동청소년복지법제를 통해 통합된 법체계의 구축의 중요성과 사회교육적 이념에 따른 일관된 지원체계의 중요성을 확인할 수 있다.

영문 초록

In the light of the importance of child welfare, the current laws distinguishes between children and adolescents. Childcare, nurturing and growth are not managed in a coherent system. In Germany, the Child and Youth Welfare Act has transformed its focus from protection to welfare and support. It is incorporated into the Social Code No. 8 and guarantees child welfare in the general social security system. Basic legal grounds can be found in the Constitution and the Volume 1 of Social Code, in addition to Volume 8 of Social Code. The basic legal relationship of child and youth welfare presupposes a three-sided relationship between the child, the parent and the state. And the role and authority of the youth agency is strongly guaranteed as a public authority. Even in relation to other benefits, the benefit for children and youth support is applied first, but it is also applied to subordinate according to the case. Funding for child and youth welfare is based on funding from state and municipal governments. The right to home use and education for child care and nursing is legally recognized as the basic principle of home nursing. We also provide support for children and adolescents with disabilities or foreigners, and support for early adulthood. In principle, the welfare of children and youth extends the age standard to young people under the age of 27, and guarantees extended support for adolescents even if they reach adulthood. The Youth Authority manages private welfare institutions through permits and ensures that the rights of children and adolescents are not infringed through legal cooperation, and has legal responsibility for systematic support. The German legal system for children and adolescents welfare legislation confirms the importance of a coherent support system in terms of the integration of legal systems and social education.
