저출산 대응 법제 분석과 향후 과제

국문 초록

현재 저출산 정책은 다양한 분야에서 시행중이다. 이에 저출산 정책의 내용과 범위를 설정하기도 쉽지 않은 것이 현실이다. 본 연구는 이러한 광범위한 저출산 정책이 법률에 나타난 모습을 분석하고 과거 약 20년간 관련 법제도가 어떠한 양상으로 변해왔는지 검토한 후 향후 저출산 대응 법제의 과제를 도출하였다. 본 연구에서는 저출산 고령사회 기본계획의 내용에 근거하여 저출산 관련 정책 분야를 보육과 돌봄, 일가정 양립을 포함한 노동시장, 모자보건 등으로 구분하여 해당 법률을 분석하였다. 분석 방법으로는 질적내용분석을 활용하였다. 분석 결과, 관련 법률은 저출산 고령사회 기본법을 비롯하여 영유아보육법, 근로기준법, 남녀고용평등법, 고용보험법, 건강가정기본법, 아이돌봄지원법, 모자보건법 등으로 범주를 설정할 수 있었고 각 법률은 현재까지 수많은 개정을 통하여 최근 5년간 가장 많은 변화를 겪은 것으로 파악된다. 종합적으로 저출산 대응 법제는 보육의 지원에서 보육의 국가 책임을 강화하는 것으로 변화한 것과 더불어 보편적인 지원의 확대와 취약계층 지원의 강화의 조화, 노동시장 여건의 강화의 방향으로 변화한 것으로 요약할 수 있다. 이러한 저출산 대응 법제의 변화를 통해 국민의 출산과 양육에 대한 권리가 사회권으로서 향상된 모습을 볼 수 있으나 향후 저출산 대응 정책과 관련하여 보육과 양육의 질 향상을 위한 관련법제도 개선, 관련 근로자 처우 개선의 법적 명시, 저출산 관련 법률의 통합 등을 통해 무엇보다 아동의 건전한 성장과 아동 권리 중심의 양육 가치와 환경에 대한 규범화가 필요할 것으로 보인다. 본 연구는 관련 법률의 종적, 횡적 분석으로 저출산 대응 법제도를 입체적으로 분석하였다는 점에서 긍정적인 역할을 할 것으로 기대되나 수요자 욕구의 변화 등이 드러나지 않음에따라 한계를 가진다. 이는 향후 보완할 예정이다.

영문 초록

The current low fertility policy is being implemented in various fields. Therefore, it is not easy to set the contents and scope of the low fertility policy. This study analyzes the pattern of this wide - ranging policy on low fertility policies and examines how the legislation has changed over the past 20 years. In this study, based on the contents of the Basic Plan for Low Fertility and Aging Society, the policy areas related to low fertility are divided into the labor market including care, work - family balance, and maternal health. Qualitative content analysis was used as an analysis method. As a result of the analysis, it was possible to set the categories according to the Basic Law on Low Fertility and Aging Society, the Child Care Act, the Labor Standards Act, the Gender Equality Employment Act, the Employment Insurance Act, the Healthy Families Basic Act, the Child Care Support Act and the Mother and Child Health Act. Has been the largest change over the past five years. Comprehensively, the low-fertility countermeasures system has changed from strengthening the national responsibility of childcare to supporting childcare, in harmony with the expansion of universal support, strengthening support for vulnerable groups, and strengthening labor market conditions. have. Above all, it is necessary to standardize the environment and the values of child care and growth of the child. Through these changes in the low fertility countermeasures system, the rights of the people to childbirth and nurture can be improved as the social rights. However, in relation to the policy of coping with the low birthrate, the related legislation for improving the quality of childcare and nursing is improved, Legal disclosure, and integration of low fertility laws.
