저출산고령사회시대 위기대응 차원에서 본 전부개정 사회보장기본법의 ｢사회보장｣ 정의규정에 대한 비판적 고찰

국문 초록

본 연구의 목적은 2013년 1월27일에 시행된 전부개정 사회보장기본법의 사회보장 정의(제3조제1호) 수정(기존의 사회적 위험에 출산, 양육, 빈곤의 새로 추가됨)을 재조명하고 그 의미를 재고(再考)한 후, 이를 통하여 현사회가 안고 있는 저출산고령사회 위기에 대한 새로운 대응방안을 제시하고자 하였다. 연구방법으로는 사회보장기본법의 ｢사회보장｣정의가 개정되기까지의 과정분석, 즉 ｢박근혜 의원 대표발의안｣과 ｢전현희 의원 대표발의안｣을 중심으로 각각의 원안과 심사/검토보고서 및 해당 국회회의록을 분석하였다. 연구결과, 사회보장의 정의 중 사회적 위험에 출산과 양육이 추가된 점은 현대 사회문제 중 가장 핵심과제인 저출산고령사회 위기극복 대비차원에서 매우 적절하다. 그러나 빈곤은 사회적 위험(질병, 장애, 노령, 실업, 사망 등)으로 인하여 소득이 일시적 중단 내지 영원히 상실됨으로써 빈곤이 발생, 즉 사회적 위험요소와 빈곤은 인과관계로 사회적 위험요소에 추가하는것은 매우 부적절하다. 본 연구의 결론 및 제언으로 출산과 양육이 사회적 위험에 포함됨에 따라 이를 위한 맞춤형 사회보장제도로는 아동수당(가족수당) 또는 사회보험제도의 도입 등을 들 수 있다. 그러나 사회보장기본법에서 사회적 위험은 보험의 방식으로 대처한다(법 제3조제2호)는 법문에 근거하여 출산과 양육으로 말미암아 국민에게 발생하는 위험을 대처하기 위한 방안으로 사회보험제도의 창설이 유효할 것이다.

영문 초록

This study aims to first review the expanded definition of “social security,” in the amendment to the Framework Act on Social Security (Subparagraph 1, Article 3) done on January 27, 2013, to include childbirth, childrearing and poverty among social risks; second to reconsider the meaning of the expansion; and third to suggest measures to deal with risks imposed by low fertility and population aging to the Korean society. The process of revision was analyzed by focusing on the original bills sponsored by (former) Grand National Party (GNP) Rep. Park Geunhye and (former) Democratic Party (DP) Rep. Jeon Hyunhee as well as the National Assembly’s examination reports and minutes. It found that including childbirth and childrearing to the definition was appropriate since they are central to coping with low fertility and population aging, the two critical challenges facing modern society. However, it was inappropriate to include poverty since it is the result of temporary or permanent loss of income due to risks such as illness, disability, aging, unemployment and death. In conclusion, this study proposes the introduction of children benefit either as a kind of public aid or social service or children insurance as a kind of social insurance, measures tailored to the expanded definition of social security. Among the two, the latter seems more feasible as a scheme to deal with childbirth and childrearing in light of the Framework Act, which calls for insurance schemes (Subparagraph 2, Article 3) to deal with risks that citizens may face.
