빈곤아동 지원제도 개선방안에 관한 고찰

국문 초록

이 논문의 목적은 아동빈곤의 해결은 실효성 있는 아동복지 정책과 그 집행이라는 문제의식을 가지고 2012년 7월부터 시행되고 있는 ｢빈곤아동 예방 및 지원 등의 관한 법률｣이 빈곤아동에 대하여 예방과 지원이라는 초기 목적을 실행하고 있는지와 그렇지 못하다면 이를 저해하고있는 문제점을 살펴보고자 하였다. 또한 한국의 아동빈곤의 실태와 아동빈곤예방법의 주요 내용을 현행 아동빈곤법예방법이 참고한 영국의 아동빈곤법의 주요내용 및 외국의 아동복지정책과 비교하여 우리나라 아동빈곤예방법의 실효성 있는 입법과제에 대하여 고찰하려 하였다. 아동빈곤의 해결은 실효성을 확보할 수 있는 아동복지를 구현하는 것이 근원적인 문제의 해결인 것이다. 동법의 실효성 확보를 위해서 기본계획 수립사항을 보다 구체적으로 규정하도록하는 추가적 검토가 필요하다. 이에 대한 검토방안으로 첫째, 사회적 지원이 필요한 아동에 대한 기초노령연금과 같은 아동수당제 도입 또한 하나의 구체적 실현방안으로 적극 검토할 필요가 있다. 둘째, 빈곤아동들이 사회적으로 가장 지원이 절실한 분야가 생계비 및 의료비 지원으로 현재 지나치게 까다롭게 적용하고 있는 부양의무자 기준의 완화가 필요하며 가족과 함께 생활하기 어려운 상황에 놓여있는 사각지대에 있는 아동에 대하여서도 현행 부양의무자 기준을 적용하는 것은 사회적인 차별로 형평성에 위배되므로 시급한 개선이 필요하다. 셋째, 기본계획 수립 시 영국과 같이 아동빈곤위원회에서 빈곤아동정책의 기본방향을 수립하여 국회에 보고서를 제출하도록 하여 그에 따라 기본계획을 수립하는 것 또한 해결 방안으로 검토해 볼 수 있다. 마지막으로 빈곤아동에 대한 구체적인 기준이 현재 보건복지부령(시행규칙)에 위임되어 있는 것을 영국의 아동빈곤법과 같이 하위법령에 위임하는 것이 아닌 아동빈곤예방법에서 직접적으로 빈곤아동의 기준을 최대한 구체적, 명확하게 법률로써 규정하는것 또한 적극 검토할 필요가 있다.

영문 초록

The purpose of this paper is to explore whether the ｢Acts on the prevention and support of child poverty｣which has been enforced from July 2012 are achieving their initial goals such as prevention and support of child poverty and if not, what the problems of the hindrances are with a critical mind that the solution of child poverty is the execution and establishment of an effective child welfare policies. Furthermore, we attempted to contemplate the reality of child poverty and effective agenda of legislation of Acts on child poverty prevention in South Korea in comparison to the main contents of Acts on child poverty in UK and foreign child welfare policies The fundamental solution of the problem of child poverty is to implement a child welfare system guaranteed to be effective. In order to ensure the effectiveness of the Acts, additional reviews are required to establish more specific basic plan items. What to review is, first of all, the introduction of child allowances similar to the elderly pension for children who need social support as one of the concrete realization strategies. Secondly, as the most urgent social support for poverty child is in the field of living and medical expenses, mitigation is required for current, overly picky standard to select a person who is under obligation to support. In addition, children who are impossible to live with their family cannot be supported according to the current standard, thus requiring an urgent improvement. Thirdly, in establishing the basic plans, it is good to review to follow the UK example where it asks committee on child poverty to submit reports on the basic direction of poverty child welfare policies to the National Assembly. Finally, it is recommended to review to establish specific and clear regulations on the standard of poverty child by laws instead of depending on subordinate laws under the department of Ministry of Health (enforcement regulations) such as the child poverty laws of the UK.
