인공지능 알고리즘을 활용한 부동산 거래의 민사법적 문제점

국문 초록

알고리즘을 활용한 부동산 거래가 시세 분석 및 가치평가, 권리분석을 넘어 부동산 중개, 부동산관리로 확장되고, 활용 빈도 역시 활발해질 것으로 예측되는 가운데 알고리즘으로 인한 편향적이거나, 부정확한 결정으로 손해를 입을 수도 있다. 이 경우 이용자는 일종의 불완전이행으로서 채무불이행을 다툴 여지가 있지만, 알고리즘을 활용한 부동산 거래 플랫폼이 미리 약관에 면책조항을 마련할 가능성이 상당할 것이다. 또한, 그렇지 않다 하더라도 알고리즘으로 인한 손해 입증이 곤란하다는 문제가 있다. 알고리즘도 제조물처럼 기술의 복잡성과 정보의 비대칭으로 인해 피해자의 손해입증이 어렵기 때문에 ｢제조물책임법｣상 “결함 추정”을 유추적용한다면, 민사책임의 실효성을 제고할 수 있을 것이다. 부동산 거래에서 AI나 알고리즘의 활용성이 안정적으로 확장되기 위해서는 부동산 거래에서 활용되는 알고리즘을 규율하는 규범을 구체적으로 마련해야 하는 것이 선행되어야 할 것이다. 이러한 규범에는 알고리즘 개발자와 부동산 거래 플랫폼이 부담하는 책임의 범위에 대해 명시되어야 할 것인데, 그 내용에 대한 설명의무와 약관과 계약서에 구체적으로 명시할 의무 역시 사후적 구제의 실효성을 제고하기 위해 포함되어야 할 것이다. 또한, 알고리즘에 활용되는 부동산 데이터의 정확성을 확보하기 위한 데이터 관리 방법 역시 모색할 필요가 있다. 부동산 거래 플랫폼에서 부동산 데이터를 검증하고, 인증하는 방안을 우선 자율규제의 형태로 제도화하는 방안이 알고리즘의 신뢰성과 활용성 측면에서 적절할 것으로 생각된다. 또한, 부동산 거래에 활용되는 알고리즘 역시 공적 기관에서 인증 체계를 갖추어 감독 의무를 부과한다면, 투명성과 신뢰성이 확보될 것이다. 2024년 4월 EU에서 세계 최초로 ｢인공지능법｣이 마련되고, 2024년 5월 미국 콜로라도주에서도 ｢인공지능법｣이 제정되면서 각국에서 AI와 관련한 법률이 본격적으로 등장하고 있지만, 부동산 분야에 특화된 규율은 아직 시도되지 않기 때문에, 부동산 거래에서 알고리즘 활용에 대한 법적 프레임워크에 대한 선제적인 논의의 축적이 긴요하다.

영문 초록

While real estate transactions through algorithms are expected to expand beyond market price analysis, valuation, and rights analysis to real estate brokerage and real estate management, and the frequency of use is also expected to increase, algorithmic biased or inaccurate decisions may result in losses. In this case, the user has room to dispute the default as a kind of incomplete performance, but there will be a considerable possibility that the real estate transaction platform using the algorithm will have a disclaimer in the terms and conditions in advance. Also, even if this is not the case, there is a problem that it is difficult to prove the damage caused by the algorithm. Algorithms, like products, are difficult to prove damage due to the complexity of technology and asymmetry of information, so if the “presumption of defects” under the Product Liability Act is applied by analogy, the effectiveness of civil liability can be improved. In order to stably expand the use of AI or algorithms in real estate transactions, it is necessary to establish specific norms governing algorithms used in real estate transactions. These norms should specify the scope of the responsibilities borne by algorithm developers and real estate transaction platforms, and the obligation to explain the contents and specify them in terms and conditions and contracts should also be included to enhance the effectiveness of post-rescue measures. It is also necessary to seek data management methods to ensure the accuracy of real estate data used in algorithms. It is considered appropriate to institutionalize the method of verifying and certifying real estate data on real estate transaction platforms in the form of self-regulation in terms of the reliability and usability of the algorithm. Algorithms used in real estate transactions will also be secured if a certification system is established by public institutions and supervisory obligations are imposed. As the world's first artificial intelligence law was established in the EU in April 2024, and the artificial intelligence law was also enacted in Colorado in May 2024, laws related to AI are emerging in each country, but regulations specific to the real estate sector have not yet been attempted, so it is essential to accumulate preemptive discussions on the legal framework for the use of algorithms in real estate transactions.
